Re: Broadcasting application 2015-0103-1 (CILV-FM Ottawa)
This letter represents a response to your request to designate certain information, filed as part of application 2015-0103-1, as confidential. Commission staff has considered your request and grants confidentiality for the following documents:
- Appendix 1: 3-Year Financial Projections Assuming Approval of Application;
- Appendix 2: 3-Year Financial Projections Assuming Denial of Application.
However, Commission staff denies confidentiality for the following document:
- Appendix 3: Underlying Assumptions – Financial Projections.
Commission staff does not grant confidentiality on supporting financial assumptions for projection years given that it will not result in any specific harm to Newcap. Further, it considers that Newcap did not provide satisfactory rational for why the above-noted document should be kept confidential.
Furthermore, while Commission staff considers that the applicant has presented a compelling argument with respect to maintaining the confidentiality of the data contained in its three year financial projections, it considers that financial projections on an incremental basis would still be required for public disclosure. Accordingly, pursuant to Section 34(1) of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure (the Rules), the Commission requires disclosure of the following information that you designated as confidential with respect to the above-noted application:
- Appendix 1: 3-Year (abridged) Financial Projections Assuming Approval of Application;
- Appendix 2: 3-Year (abridged) Financial Projections Assuming Denial of Application;
- Appendix 3: Underlying Assumptions – Financial Projections.
As indicated above, the document should contain an abridged version of your three year financial projections that includes incremental financial projections (both if approved and if denied).
Please note that the information requested herein should be received at the Commission by no later than 7 April 2015.
Timeline change
Commission staff notes that the intervention deadline for this application has passed. However, considering that this request for disclosure will result in the addition of previously unavailable information on the public record, additional comments from interveners with respect to the new information only will be accepted. As such, the timetable for the proceeding is changed as follows:
