Dear Ms. Leonard,
This is in reference to the application by The Banff Centre to amend the licence of the English-language tourist radio programming undertaking CFPE-FM Banff, Alberta, which was published as a Part 1 application on 10 September 2014.
In the above-noted application you have requested to increase CFPE-FM’s overall music allowance from 16% to 23%, and to increase its category 2 music allowance from 25% to 33%.
With respect to the second part of your request, Commission staff notes that CFPE-FM currently has no specific condition of licence related to the broadcasting of category 2 music it may broadcast in each broadcast week. Rather, its specific condition of licence imposes a minimum amount of category 3 music that must be broadcast in each broadcast week. Therefore, any request to modify this condition must refer directly to the terms set out within it. The current condition of licence reads as follows:
2. The licensee shall devote a maximum of 16% of its programming in each broadcast week to musical selections, of which 75% or more must be musical selections drawn from content category 3 (Special Interest Music).
In light of the above, please confirm if it is your intent to request the decrease of the amount of category 3 music from which CFPE-FM must draw its musical programming from the current 75%, and if so, what the proposed new minimum level of category 3 music would be.
The information requested herein should be received by the Commission no later than 22 September 2014, failing which, your application may be returned to be completed and resubmitted with the Commission should you wish to pursue this proposal.
