Dear Sir:

The Commission is in receipt of a letter dated 15 December 2013 in which the DiversityCanada Foundation submitted Reply Comments to the above-named Application.

Staff notes that DiversityCanada Foundation is an intervener in this proceeding, having filed, on behalf of itself and the National Pensioners Federation, a submission dated 5 December 2013 in response to the Application. According to paragraph 27(1) of the CRTC Rules of Practice and Procedure (the Rules), the applicant may file a reply to an answer or to the document of an intervener: the Rules do not provide an intervener, such as DiversityCanada Foundation in this proceeding, with a right to file reply submissions.

Accordingly, DiversityCanada’s reply is out of process and therefore will not form part of the public record of this proceeding. Staff is therefore returning to DiversityCanada its reply submission.
