Preamble for items 1 to 14
On 25 March 2013, the Commission issued Broadcasting Notice of Consultation 2013-149 calling for applications for broadcasting licences for radio stations to serve Vancouver, British Columbia. The Commission indicated that applications were to include all of the information requested in the appendices to that notice of consultation, failing which the application would not be considered as part of the process.
In response to this call, the Commission has received a number of applications for new services as well as several applications for technical changes involving transmitter additions for the Vancouver radio market.
Items 1 to 10 are technically mutually exclusive, each proposing the use of frequency 107.7 MHz.
Items 11 and 12 are technically mutually exclusive, each proposing the use of frequency 600 kHz.
These applications along with item 13 will be treated as competitive radio applications for the Vancouver radio market.
Prior to the issuance of Broadcasting Notice of Consultation 2013-149, the Commission received an application for a broadcasting licence to operate a low-power religious FM radio station to serve Aldergrove, British Columbia (item 14). This item is also technically mutually exclusive with items 1 to 10 for the use of frequency 107.7 MHz and will therefore be considered together with the remaining applications.
Alternate frequencies
Several applicants proposed alternate frequencies and provided technical suitability documentation in support of their use. These proposals will be considered in this process and are identified in this notice. Applicants are reminded that, consistent with the approach set out in Broadcasting Notice of Consultation 2013-149, the Commission will not consider any alternate frequencies for the applications other than those identified in this notice.
Preamble for items 15 and 16
On 21 June 2013, the Commission issued Broadcasting Notice of Consultation 2013-301, calling for applications for broadcasting licences for radio stations to serve Cranbrook, British Columbia. The Commission indicated that applications were to include all of the information requested in the appendices to that notice, failing which the application would not be considered as part of this process.
In response to this call, the Commission has received two applications for new services for the Cranbrook radio market.

The Commission intends to consider, subject to interventions, item 17 during the non-appearing phase of the hearing.
1. South Fraser Broadcasting Inc.

Application by South Fraser Broadcasting Inc. for a broadcasting licence to operate an English-language commercial FM radio station in Surrey.
The station would operate on frequency 107.7 MHz (channel 299A) with an average effective radiated power (ERP) of 1,066 watts (maximum ERP of 2,500 watts with an effective height of antenna above average terrain (EHAAT) of 132.5 metres).
The applicant has also submitted an alternate proposal to operate The station on frequency 91.5 MHz (channel 218A) with an average ERP of 290 watts (maximum ERP of 1,000 watts with an EHAAT of 132.4 metres).
The applicant proposes a diverse music format consisting of mainstream Adult Contemporary, gold-based Adult Contemporary and Contemporary Triple AAA music.

Applications by South Asian Broadcasting Corporation Inc. to amend the broadcasting licence for the ethnic commercial specialty radio station CKYE-FM Vancouver by adding FM transmitters in Surrey and Abbotsford to rebroadcast the programming of CKYE-FM.
According to the licensee, the addition of transmitters in Surrey and Abbotsford would address the impaired reception of CKYE-FM caused by the HD IBOC transmissions from the radio station KISM Bellingham, Washington, which operates on frequency 92.9 MHz and thus broadcasts on the first adjacent frequency to CKYE-FM, which operates on frequency 93.1 MHz.
In regard to Surrey, the licensee proposes, as its preference, to operate the new transmitter on frequency 107.7 MHz (channel 299A) with an average effective radiated power (ERP) of 422 watts (maximum ERP of 750 watts with an effective height of antenna above average terrain (EHAAT) of 123.3 metres) (application 2013-0885-9). As a first alternate proposal (application 2013-0899-0), the new transmitter would operate on frequency 107.7 MHz (channel 299A1) with an average ERP of 130 watts (maximum ERP of 160 watts with an EHAAT of 123.3 metres). As a second alternative proposal (application 2013-0896-6), the new transmitter would operate at 91.5 MHz (channel 218A1) with an average ERP of 23.5 watts (maximum ERP of 100 watts with an EHAAT of 123.3 metres).
The licensee states that any of the above proposals would address severe FM signal reception problems that are affecting listeners in the areas of Surrey, Vancouver, New Westminster, Burnaby and Langley, British Columbia, as well as other municipalities.
In the applications proposing the use of 107.7 MHz, the licensee also requests an amendment to CKYE-FM’s condition of licence relating to the broadcast of third-language programming, which reads as follows:
4. Not less than 90% of the programming in each broadcast week shall be ethnic programming, and all of the ethnic programming shall be third-language programming.
The licensee seeks to replace that condition of licence with the following:
The licensee shall devote a minimum of 85% of the programming broadcast during each broadcast week to third-language programming, as defined in the Radio Regulations, 1986.
In regard to Abbotsford (application 2013-0902-1), the licensee proposes to operate the new transmitter on frequency 107.9 MHz (channel 300A1) with an ERP of 250 watts (non-directional antenna with an EHAAT of 62 metres). The licensee states that the proposed transmitter would address severe reception problems that are affecting listeners within the station’s existing 0.5 mV/m coverage, principally in the areas of Abbotsford and Mission, British Columbia.
As part of these applications, the licensee provided two compact discs containing audio files that document the signal impairment of CKYE-FM. The Commission notes that the audio from these compact discs is not available for download from its website. However, the compact discs will be made available for public examination at the Commission’s Vancouver, British Columbia regional office and in the examination room at the hearing.

The station would operate on frequency 96.5 MHz (channel 243C) with an effective radiated power (ERP) of 2,600 watts (non-directional antenna with an effective height of antenna above average terrain (EHAAT) of 1,054 metres).
The transmitter in Fernie would operate on frequency 91.9 MHz (channel 220A) with an ERP of 360 watts (non-directional antenna with an EHAAT of -536 metres).
The applicant proposes a modern Adult Contemporary music format.
The Commission may withdraw this application from the public hearing if it is not advised by the Department of Industry, at least twenty days prior to the hearing, that the application is technically acceptable.

Application (2013-1070-6) by United Christian Broadcasters Canada (UCB) for authority to acquire from Thunder Bay Christian Radio the assets of the specialty FM (Christian music) radio station CJOA-FM Thunder Bay.
The applicant also requests a new broadcasting licence to continue the operation of the station, with amendments to the station’s conditions of licence. Specifically, UCB proposes to delete the following conditions of licence, currently set out in Various radio programming undertakings (specialty and ethnic) – Licence renewals, Broadcasting Decision CRTC 2013-161, 28 March 2013:
- The station’s programming shall be 100% locally produced.
- The licensee shall not broadcast any commercial messages.
In its second application (2013-1074-7), UCB proposes to change CJOA-FM’s authorized contours by increasing the effective radiated power from 50 to 250 watts. This increase in power would result in a change of CJOA-FM’s status from a low-power unprotected service to a protected regular Class A1 service.
UCB is a not-for-profit corporation controlled by its board of directors.
Pursuant to the Asset Purchase Agreement dated 17 April 2013, the purchase price for the assets of CJOA-FM is $1.
Should the Commission approve application 2013-1070-6, UCB would become the licensee of CJOA-FM.

Procedure
Deadline for interventions or answers

The Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure, SOR/2010-277 (the Rules of Procedure), set out, among other things, the rules for content, format, filing and service of interventions and answers of respondents, the procedure for filing confidential information and requesting its disclosure, and the conduct of the public hearing. Accordingly, the procedure set out below must be read in conjunction with the Rules of Procedure and its accompanying documents, which can be found on the Commission’s website under “CRTC Rules of Practice and Procedure.”
An intervention or an answer from a respondent must be filed with the Commission and served on the applicant on or before the above-mentioned date. An answer from a respondent must also be served on any other respondent.
In accordance with the Rules of Procedure, a document must be filed with, not merely sent to, the Commission by 5 p.m. Vancouver time (8 p.m. Ottawa time) on the date it is due. The Commission takes no responsibility for postal delays and will not notify a party whose submission is received after the deadline date. Late submissions will not be considered by the Commission and will not be made part of the public file.
For applications to be considered during the appearing phase of the hearing, the intervention or answer must include one of the following statements in either the first or the last paragraph:
- 1. I request to appear at the public hearing.
- 2. I do not want to appear at the public hearing.
The applicant, respondents and interveners are permitted to coordinate, organize and file, in a single submission, interventions of other interested persons who share their position but do not wish to appear at the hearing as a “Joint Supporting Intervention.” More information on how to do so and a template for the covering letter to be filed by the parties can be found in Changes to certain practices for filing interventions – Expansion of filing practices to include the filing of joint supporting comments for broadcasting policy proceedings, Broadcasting Information Bulletin CRTC 2010-28-1, 10 December 2010.
Interventions and answers will be considered by the Commission and will form part of the public record of the proceeding without further notification to parties, provided the procedures set out in the Rules of Procedure and this notice have been followed. Parties will be contacted only if their submissions raise procedural questions.

A true copy of each intervention or answer from a respondent must be sent to the applicant and, in the case of a respondent to an application, to any other respondent.
The Commission advises those who file and serve by electronic mode to exercise caution when using e-mail for service of documents, as it may be difficult to establish that service has occurred.
Parties must ensure that, before initiating service through electronic mode, they will be able to satisfy the Commission, upon request, that service was completed. The sender must keep proof of the sending and the receipt of the document for 180 days after the day on which it is filed.
Submissions longer than five pages should include a summary.
Each paragraph of the submission should be numbered. In addition, where the intervention is filed by electronic means, the line ***End of document*** should be entered following the last paragraph of the document, as an indication that the document has not been altered during electronic transmission.
Interventions and answers must clearly identify the application referred to and indicate whether parties support or oppose the application, or, if they propose changes to it, include the facts and grounds for their proposal.
In the event that an application to be considered during the non-appearing phase of the hearing is brought to the oral phase of the hearing, and if parties wish to appear, they must provide reasons why their written interventions or answers are not sufficient and why an appearance is necessary. Parties requiring communication support must state their request on the first page of their intervention. Only those parties whose requests to appear have been granted will be contacted by the Commission and invited to appear at the public hearing.
Persons requiring communications support such as assistance listening devices and sign language interpretation are requested to inform the Commission at least twenty (20) days before the commencement of the public hearing so that the necessary arrangements can be made.
Important notice
All information that parties provide as part of this public process, except information designated confidential, whether sent by postal mail, facsimile, e-mail or through the Commission’s website at www.crtc.gc.ca, becomes part of a publicly accessible file and will be posted on the Commission’s website. This information includes personal information, such as full names, e-mail addresses, postal/street addresses, telephone and facsimile numbers, and any other personal information parties provide.
The personal information that parties provide will be used and may be disclosed for the purpose for which the information was obtained or compiled by the Commission, or for a use consistent with that purpose.
Documents received electronically or otherwise will be put on the Commission’s website in their entirety exactly as received, including any personal information contained therein, in the official language and format in which they are received. Documents not received electronically will be available in PDF format.
The information that parties provide to the Commission as part of this public process is entered into an unsearchable database dedicated to this specific public process. This database is accessible only from the web page of this particular public process. As a result, a general search of the Commission’s website with the help of either its own search engine or a third-party search engine will not provide access to the information that was provided as part of this public process.
The Commission encourages parties and interested persons to monitor the record of the proceeding, available on the Commission’s website, for additional information that they may find useful when preparing their submissions.
