RE: Fibernetics Corporation Tariff Notice 6

On 21 August 2012, the Commission received an application by Fibernetics Corporation (Fibernetics) under Tariff Notice 6, in which the company proposed revisions to its Access Services Tariff. The application was subsequently replaced on 31 August 2012 and amended on 14 September 2012. The company submitted its application as a Group B tariff filing.

Since Fibernetics proposes to withdraw the provision of separate exchange area service (EAS) trunks, Commission staff considers that the company’s application does not meet the definition of a Group B tariff filing under Approval processes for tariff applications and intercarrier agreements, Telecom Information Bulletin 2010-455, 5 July 2010 (Information Bulletin 2010-455). However, for efficiency, the Commission will process this application as a destandardization/withdrawal tariff filing, with an effective date no earlier than 45 business days after receipt of a complete filing, rather than close the file and require the company to re-file.

Accordingly, the application will follow the procedures described in Information Bulletin 2010-455 for destandardization/withdrawal tariffs.

- Interested parties may file interventions within 30 business days of the filing date of an application; and
- the applicant may file reply comments within 10 business days of the deadline for filing interventions.
