RE: Review of regulatory framework for the small incumbent local exchange carriers and related matters, Telecom Notice of Consultation CRTC 2011-348-3 Procedural Request by TELUS Communications Company (“TELUS”)

Dear Mr. Woodhead:

On 12 March 2012, the Commission received a request from TELUS to delay the proceeding initiated by Telecom Notice of Consultation CRTC 2011-348, as amended by Telecom Notice of Consultation CRTC 2011-348-3, until such time as all small ILECs have filed their proposals and responses to the initial Commission requests for information.  TELUS argued that such a delay is necessary to ensure that interested parties will be able to submit a meaningful set of requests for information to all small ILECs, currently scheduled for 14 March 2012.

Commission staff notes that in a letter dated 16 February 2012, the Commission determined that the proceeding, as amended by Telecom Notice of Consultation 2011-348-3, would continue as scheduled while the Commission considered ACTQ/OTA’s stay application. Commission staff notes that the Commission’s decision on that stay application has not yet been rendered.

Commission staff acknowledges the concerns raised by TELUS.  However, at this time, Commission staff is of the view that the proceeding should continue as scheduled in Telecom Notice of Consultation CRTC 2011-348-3. Once the Commission has rendered its decision on the stay application, any necessary modifications to the proceeding could be made at that time.
