Dear Ms. Griffin-Muir:

On 5 December 2011, the Commission received a request from MTS Allstream Inc. (MTS Allstream) to expand the scope of the proceeding initiated by Telecom Notice of Consultation 2011-348, and resumed by Telecom Notice of Consultation 2011-348-2, to consider:

whether, or for how long, and to what degree, the regulatory framework for the small incumbent local exchange carriers (small ILECs) should continue to apply to companies owned or controlled by large carriers; and
whether changes should be made to the regulatory framework that applies to TELUS Communications Company (TELUS) in its incumbent territory in Quebec, and to Télébec, Limited Partnership (Télébec).

With respect to the first matter raised by MTS Allstream, Commission staff notes that, pursuant to paragraph 31 of Telecom Notice of Consultation 2011-348-2, interveners are entitled to raise other issues relevant to the small ILEC regulatory framework. Commission staff considers that this matter could be appropriately raised for consideration under the process already set out in this proceeding.

With respect to MTS Allstream’s second matter, Commission staff notes that the regulatory framework applicable to TELUS in its incumbent territory in Quebec and to Télébec differs from that applicable to small ILECs and has historically been addressed by the Commission separately from the framework applicable to small ILECs. Accordingly, Commission staff considers that it would not be appropriate to expand the scope of this proceeding for this matter. Commission staff notes that matters relating to the regulatory framework applicable to TELUS in its incumbent territory in Quebec and to Télébec may be brought before the Commission by an application under Part I of the Canadian Radio-television and Telecommunications Commission Rules of Practice and Procedure SOR/2010-277.
