Dear Madam, Sir:

Re:  Applications related to Telecom Decisions 2010-802 and 2011-44

On 22 November 2010 Canadian Network Operators Consortium Inc. (CNOC) applied to stay implementation of Telecom Decision 2010-802 and to review and vary that decision.
On 28 January 2011, Vaxination Informatique applied to stay implementation of Telecom Decision 2011-44.

These decisions related to the application of usage-based billing (UBB) by Bell Aliant Regional Communications, Limited Partnership and Bell Canada (the Bell companies) to wholesale broadband access services.

Subsequent to its receipt of these applications, the Commission initiated a proceeding to review billing practices for wholesale residential high-speed access services that included consideration of UBB[1].

In light of the Commission’s recent decision in this proceeding, the files associated with CNOC’s and Vaxination Informatique’s above-referenced applications have been closed.

Yours sincerely,
