RE: Tariff Notice 910 – Withdrawal of Managed Digital Private Line Service and Enhanced Service Extension Feature
Dear Sir:
On 3 June 2011, the Commission received a letter from Bell Canada requesting a change to the effective date of the withdrawal of National Services Tariff (NST) item 303, Managed Digital Private Line Service and the associated Enhanced Service Extension Feature of NST item 304, Digital Private Line Solutions Service Extension Features to 30 September 2011.
The Commission provided final approval of the associated tariff withdrawal application, Tariff Notice 910 (TN 910), in Telecom Order CRTC 2011-178 (Order 2011-178) on 11 March 2011. The effective date of the withdrawal of service approved in that order is 30 June 2011.
As TN 910 has been approved in Order 2011-178, a request to change the approved effective date will require a new tariff application. It is the opinion of Commission staff that the new application does not meet the criteria for either a Group A or Group B tariff filing described in Telecom Information Bulletin CRTC 2010-455, Approval process for tariff applications and intercarrier agreements, 5 July 2010(TIB 2010-455). Commission staff considers that the new application may be filed as a tariff filing under the type “Destandardization and/or withdrawal of tariffed service”. Considering the circumstances, Commission staff is of the opinion that a reference to TN 910 will be sufficient to fulfill the documentation and majority of information requirements for a destandardization/withdrawal of service application as outlined n TIB 2010-455. However, Commission staff notes that Bell Canada should include in the new application information about notification it has made, or will be making, to affected customers with regards to the requested change in the effective date for the withdrawal of the service.
