Application by TVA Group Inc. to amend the broadcasting licence for the French‑language television programming undertaking CFCM‑TV Québec.

The licensee proposes to add a digital transmitter at Québec to broadcast the programming of CFCM‑TV, in the digital format.

The transmitter would operate on channel 17 with an average effective radiated power (ERP) of 122,500 watts (maximum ERP of 210,000 watts with an effective height of antenna above average terrain of 117.2 metres).

 The licensee wishes to comply with Revised licensing framework for over-the-air digital television services, Broadcasting Regulatory Policy CRTC 2010‑69, 10 February 2010.

Application by 1486781 Ontario Limited (1486781 Ontario) for authority to effect a change to its effective control through the transfer of all of its issued and outstanding shares from its sole shareholder, Anthony Schleifer, to Durham Radio Inc. (Durham Radio), pursuant to subsection 11(4) of the Radio Regulations, 1986.

The proposed transaction is conditional to a favourable decision relating to the proposed changes to CFWC‑FM Brantford’s conditions of licence, set out in application 2010‑0618‑0, which is included in this notice of consultation.

1486781 Ontario is the licensee of the English‑language specialty FM radio programming undertaking CFWC‑FM.

Durham Radio is controlled by Kirk Douglas, who owns approximately 82% of the voting interests in Durham Radio.

Following this transaction, Durham Radio would become the sole owner of 1486781 Ontario. As a result, Kirk Douglas would exercise control of 1486781 Ontario.

The purchase price for the acquired shares, which is set out in the Share Purchase Agreement, is $265,000.

The applicant does not propose any tangible benefits on the basis that the station has been unprofitable for the past several years.

Application by 1486781 Ontario Limited to amend the broadcasting licence for the English‑language specialty FM radio programming undertaking CFWC‑FM Brantford.

The licensee proposes to delete the following conditions of licence:

A minimum of 95% of all musical selections broadcast during each broadcast week shall be devoted to selections drawn from subcategory 35 (Non‑classic religious).

The licensee shall ensure that a minimum of 15% of musical selections from category 3 (Special interest music) broadcast during each broadcast week are Canadian selections.

The licensee shall broadcast, in any broadcast week, no more than 20% hit material as defined in Revised Policy on the Use of Hits by English-Language FM Radio Stations, Public Notice CRTC 1997‑42, 23 April 1997.

The licensee proposes to replace the station’s Christian music format with a broad‑based rock format.

This application is non‑severable to application 2010‑0602‑3, which is included in this notice of consultation.

The intervention must be received by the Commission and by the applicant on or before the above‑mentioned date.

The Commission cannot be held responsible for postal delays and will not notify a party whose intervention is received after the deadline date. In such a case, the intervention will not be considered by the Commission and will not be part of the public file.

Interventions will be considered by the Commission and will form part of the public record of the proceeding without further notification to intervening parties, provided the procedure set out below has been followed. Parties will be contacted only if their submissions raise procedural questions.

A true copy must be sent to the applicant, and proof that this has been done must accompany the intervention sent to the Commission.

The Commission advises those who file and serve by electronic mode to exercise caution when using e‑mail for service of documents or notification, as it may be difficult to establish that service has occurred.

Parties must ensure that, before initiating service through electronic mode, they will be able to satisfy the Commission, upon request, that service of the notification was completed.

Submissions longer than five pages should include a summary.

In addition, where the intervention is filed by electronic means, the line ***End of document*** should be entered following the last paragraph of the document, as an indication that the document has not been damaged during electronic transmission.
