RE: Bell Aliant Tariff Notice 358

Dear Mr. Henry:

In Telecom Order 2009-733, 30 November 2009, the Commission granted interim approval to Bell Aliant Regional Communications, Limited Partnership's (Bell Aliant) ex parte application in Tariff Notice (TN) 358. In that Order, the Commission directed Bell Aliant to file with the Commission, by 2 December 2009, an electronic version of TN 358, for the Commission's website. In addition, the Commission noted that Regulatory policy – Approval mechanisms for retail and CLEC tariffs, Telecom Decision CRTC 2008-74, 21 August 2008, allows interveners to comment, within 25 days, on Group B tariff applications that have been placed on the public record.

By letter, dated 3 December 2009, Bell Aliant noted that the standard comment intervals would require interveners to file comments by 28 December 2009, and Bell Aliant to submit a reply by 8 January 2009. As these comment and reply comment dates fall during the Christmas period, Bell Aliant proposed revisions to the process such that interveners’ comments and Bell Aliant’s reply comments would be required by 11 January 2010 and 21 January 2010, respectively.

Given that the comments and reply comment dates fall during the Christmas periods, interveners may file comments on this application by 11 January 2010 and Bell Aliant may file reply comments by 21 January 2010.

Where a document is to be filed or served by a specific date, the document must be actually received, not merely sent, by that date

Yours sincerely,
