Re: TBayTel Tariff Notice 151 - Comments


Dear Madams, Sirs:


The Commission is in receipt of comments filed by Shaw dated 29 September 2009 and Rogers dated 4 November 2009 addressing TBayTel’s Tariff Notice 151, filed with the Commission on 24 July 2009.


In its correspondence, Shaw and Rogers both acknowledged that its comments were being submitted after the 25 day comment period provided for Group B tariff applications. Shaw and Rogers argued that they had only recently become aware that TBayTel’s proposed wireless service provider (WSP) E911 proposal included modifications to TBayTel’s 9-1-1 Public Emergency Reporting Service tariff.


By letters dated 30 September 2009 and 4 November 2009, TBayTel submitted that the above Shaw and Rogers submissions contravened the Commission’s prescribed 25-calendar day comment period for Group B tariff filings.


Commission staff is of the view that Shaw’s 29 September 2009 and Rogers’ 4 November 2009 comments address issues that are material to the Commission’s proper understanding and disposition of TBayTel’s tariff application.


Commission staff further notes that TBayTel’s WSP E9-1-1 service proposal is scheduled to be implemented for 1st February 2010.


In light of the above, Commission staff considers that to accept Shaw’s 29 September 2009 and Rogers’ 4 November 2009 comments would be in the public interest and would not prejudice TBayTel provided that TBayTel is afforded a meaningful opportunity to respond.
Accordingly, TBayTel may file comments in reply to Shaw’s and Rogers’ submissions by no later than 10 December 2009, serving a copy on Shaw and Rogers. TBayTel’s reply comments are to be filed and served, not merely sent, by the above date.
