RE: Part VII application for forbearance from the regulation of residential local exchange services in the exchanges of Chesterville, Norbertville, Ste-Victoire, Tingwick and Villeroy, Quebec

Dear Mr. Gilbert,

On 30 September 2009, the Commission received the above-mentioned Part VII application from Télébec, Société en commandite (Télébec). In this application, Télébec asked for forbearance based on the regulatory frameworks of Telecom Decision 94-19 and Telecom Decision 2006-15 as amended.

Commission staff note that the forbearance criteria in Telecom Decision 2006-15 as amended replace the criteria that were established in Telecom Decision 94-19. Therefore, Télébec’s application will be considered in light of the criteria established in modified Decision 2006 -15 as amended, including the rivalrous behaviour criterion. Commission staff ask Télébec to submit all amendments to his application by 19 October 2009 to reflect the requirements of Telecom Decision 2006-15 as amended.

Competitors must file comments by 9 November 2009 in accordance with the procedures set out in Telecom Decision 2006-15 as amended. Télébec may file reply arguments by 16 November 2009.

Where a document is to be filed or served by a specific date, the document must be actually received, not merely sent, by that date.
