CILK-FM Kelowna and its transmitter VF2329 Big White Mountain – Technical changes

The Commission approves the application by Astral Media Radio (Toronto) Inc. and 4382072 Canada Inc., partners in a general partnership carrying on business as Astral Media Radio G.P. (Astral), to amend the broadcasting licence for the radio programming undertaking CILK-FM Kelowna in order to change the frequency of its transmitter VF2329 Big White Mountain from 103.9 MHz (channel 280LP) to 93.1 MHz (channel 226A) and to change its authorized contours by increasing the effective height of antenna above average terrain from 215 to 600.8 meters. All other technical parameters remain unchanged. The implementation of these technical changes is subject to the notification by the Department of Industry (the Department) discussed in paragraph 4 below. The Commission did not receive any interventions in connection with this application.

The application was triggered by Use of frequency 103.9 MHz by the new station in Kelowna, Broadcasting Decision CRTC 2008-164, 7 August 2008, in which the Commission approved the application by Vista Radio Ltd. (Vista) to operate its new FM radio station in Kelowna at 103.9 MHz (channel 280C1) with an average effective radiated power of 5,200 watts. Astral indicated that Vista's new station will be co-channelled with VF2329 at 50 kilometres northwest, which is extremely short-spaced, and that changing the frequency of VF2329 will minimize potential signal interference. The licensee plans to use the same transmitter, antenna and tower.

The Commission notes that these technical changes will result in a change in the status of VF2329 from that of a low-power unprotected service to that of a regular Class A protected transmitter.
 

Condition prior to the implementation of the new technical parameters

The Commission reminds the licensee that pursuant to section 22(1) of the Broadcasting Act, this authority will only be effective when the Department notifies the Commission that its technical requirements have been met and that a broadcasting certificate will be issued. Therefore, in the absence of the notification by the Department, the licensee will not be able to implement the new technical parameters approved in this decision.
