PREAMBLE |
|
On 7 November 2007, the Commission issued Broadcasting Public Notice CRTC 2007-123, calling for applications for a broadcasting licence to carry on a radio programming undertaking to serve Winnipeg, Manitoba. |
|
Items 1 to 4 |
|
In response to this call, the Commission received four applications for licences to serve this market. |
|
These applications are technically mutually exclusive for the use of two frequencies: |
|
Items 1 and 2 are technically mutually exclusive proposing the use of the frequency 106.3 MHz.
|
|
Items 3 and 4 are technically mutually exclusive proposing the use of the frequency 104.7 MHz.
|
|
These applications will be considered as competitive radio applications for Winnipeg. |
|
Item 5 |
|
This involves a radio renewal application that has been found to be operating in apparent non-compliance with the Radio Regulations, 1986 and with certain conditions of licence. |
|
Items 6 to 10 |
|
The Commission intends to consider, subject to interventions, items 6 to 10 during the non-appearance phase of the public hearing. |

The applicant proposes to broadcast a minimum of 126 hours of station-produced programming during each broadcast week, with a minimum of 10 hours of Cree and Ojibway languages programming. The applicant also proposes that 50% of the music broadcast will be performed or composed by Aboriginal talent. NCI has noted that this programming will be geared to a young urban aboriginal audience. |

Application by Arctic Radio (1982) Limited to renew the broadcasting licence of the commercial radio programming undertaking CFAR Flin flon, expiring 31 August 2008. |

It appears to the Commission that the licensee may have failed to comply with the Radio Regulations, 1986 relating to the broadcast of Canadian content for category 2 music and its condition of licence to broadcast a minimum of two hours of Cree-language programming during the broadcast week of 5 to 11 November 2006. |
|
The Commission intends to inquire into this matter at the hearing. The Commission expects the licensee to demonstrate at this hearing, why a mandatory order should not be issued requiring the licensee to comply with Radio Regulations, 1986 relating to the broadcast of Canadian content for category 2 music and its condition of licence to broadcast a minimum of two hours of Cree-language programming during the broadcast week. |

The Commission notes that, in Decision CRTC 2004-334, the station was issued a four-year short term renewal based on its failure to comply with Radio Regulations, 1986 relating to the broadcast of Canadian content for category 2 music and its condition of licence to broadcast a minimum of two hours of Cree-language programming during each broadcast week. |
