RE:   Tariff Notice 105 - Proposed rate increase to Business Line Rates

On 9 October 2008, the Commission received an application by CityWest, under cover of Tariff Notice 105, in which the company proposed to increase its Business Line Rates.

Commission staff notes that the rate increases proposed by CityWest in its application are beyond those currently allowed under its current regulatory framework set out in Revised regulatory framework for the small incumbent local exchange carriers, Telecom Decision CRTC 2006-14, 29 March 2006.

Accordingly, this application will not be approved on an interim basis on the 15th calendar day after it was received .   The Commission intends to dispose of this application within 45 business days of receipt of the filing.

Yours sincerely,
