RE:   Application by the City of Baie-Comeau against the TELUS Communications Company under Part VII of the Rules of Procedure and sections 42 to 45, 55 and 61 of the Telecommunications Act

The CRTC acknowledges receipt of the above-referenced application, dated 4 April 2008, filed by the City of Baie-Comeau (the City) against the TELUS Communications Company (TCC ). The CRTC also acknowledges receipt of the letters from the City dated 10 and 17 April 2008 and those from TCC dated 9 and 15 April 2008.

In its application, the City requests that the CRTC:

  • order TCC to remove and move its underground telecommunications facilities and all related assets from La Salle Boulevard in Baie-Comeau so that the City may perform repair work on the boulevard and its infrastructure, notwithstanding an immediate decision on the allocation of the moving cost; and
  • rule on the allocation of the cost of moving TCC's underground telecommunication cables and conduits at a later date.

CRTC staff notes that the parties agreed to call upon the CRTC as a mediator to resolve the cost allocation issue and agreed to stay the aforementioned proceeding with respect to this part of the application. If the parties are unable to come to an agreement following mediation, they will resume the usual resolution process under Part VII.

CRTC staff also notes that Ted Woodhead confirmed to CRTC staff by telephone on 17 April 2008 that TCC undertakes, on the express condition that mediation be initiated as soon as possible, to move its underground telecommunication cables and conduits as required so that the City may perform the repair work. It is understood that the City has a duty to contact Gaétan Rousseau of TCC (418-722-5979) to coordinate the facilities moving activities.

CRTC staff requests that the City and TCC provide the names and contact information of the individuals who will represent them in the mediation by 23 April 2008. These individuals must be authorized to make decisions on behalf of the parties they represent. CRTC staff will organize conference calls as soon as possible with the objective of resolving the cost allocation issue related to moving the TCC underground facilities.
