Licence renewals

1.

The Commission renews the broadcasting licences for the Type B Native FM radio programming undertakings listed below from 1 September 2008 to 31 August 2012. These licences will be subject to the conditions specified therein as well as to the conditions set out in the appendix to this decision.

In Broadcasting Public Notice 2008-53, the Commission noted that these licensees may have failed to comply with section 9(2) of the Radio Regulations, 1986 (the Regulations) pertaining to the submission of annual returns, for the years mentioned below1.

The Commission notes that this is the first time that these licensees have been found to be in non-compliance with the Regulations as they pertain to the filing of annual returns. Specifically, the licensees' annual returns for the broadcast years mentioned below were not filed by the prescribed date of 30 November of each broadcast year.

As set out in Circular No. 444, the Commission notes that, when apparent non-compliance is observed for the first time, the station is normally granted a short-term licence renewal, generally for four years, to permit a further review of its compliance within a reasonable period of time. As noted above, this is the first time that these licensees have been found to be in non-compliance with respect to the filing of annual returns. As such, the Commission finds it appropriate to renew the licences for these undertakings for a short-term period of four years, in accordance with Circular No. 444. This short-term renewal will enable the Commission to assess at an earlier date the licensees' compliance with the Regulations.

The Commission did not receive any interventions in connection with these applications.

Terms

  The licence will be in effect from 1 September 2008 to 31 August 2012.
 

Conditions of licence

 

1. In each broadcast week, a minimum of 35% of all musical selections from Category 2 (Popular music) shall be devoted to Canadian selections played in their entirety.

 

2. The licensee shall adhere to the Canadian Association of Broadcasters' Equitable Portrayal Code, as amended from time to time and approved by the Commission. However, the application of the foregoing condition of licence will be suspended if the licensee is a member in good standing of the Canadian Broadcast Standards Council.

 

3. The licensee shall adhere to the provisions of the Canadian Association of Broadcasters' Broadcast Code for Advertising to Children, as amended from time to time and approved by the Commission.

 

Encouragement

  The Commission encourages the applicant, should it wish to broadcast wrap-around programming after its daily sign-off, to use programming obtained from another native radio station or network.

1In Broadcasting Public Notice 2008-53, the Commission indicated that Native Communications Society of the N.W.T. was in compliance. However, after reviewing the applicant's file, the Commission notes that the applicant was late in filing its 2002 to 2007 annual returns.
