  Application by Cogeco Cable Canada Inc. (Cogeco) for a Class 1 regional licence for its cable broadcasting distribution undertakings (BDUs) serving the above-noted locations.
  Cogeco is currently operating these undertakings under separate Class 1 licences, which will expire on 31 August 2007.
  Cogeco proposes a "zone-based" approach to community programming. The proposal can be summarized as follows:
 

(1) For the purpose of community programming, the authorized service areas would be divided into fourteen zones. With the exception of Zone 9, each zone would include a Class 1 service area with its own headend and community programming studio facilities. Seven of the fourteen proposed zones would consist of a single service area. The remaining zones would consist of one or more Class 1 systems with one or two smaller Class 3 service areas.

 

(2) For each zone, Cogeco would comply with the minimum requirements for 60% and 30% local community and community access programming, respectively, set out in the Broadcasting Distribution Regulations.

  In order to put this approach into effect, the licensee proposes to add the following conditions of licence for their systems noted above to include the following provision:
 

1. For the purpose of sections 27, 27.1, 28 and 29 of the Broadcasting Distribution Regulations (the Regulations) and of this condition of licence, each of the following zones shall be considered a licensed area:

3. For the purpose of paragraph 27.1(3) of the Regulations, "community television access programming" shall constitute programming produced by an individual, group or community television corporation residing within the licensed area.

  Cogeco is currently operating these undertakings under separate Class 3 licences, except for the undertakings serving Bath and Wallaceburg, for which Cogeco is exempted from holding a broadcasting licence. Cogeco has included these exempted undertakings in its application since they no longer meet the exemption criteria. These licences expire on 31 August 2007.
  Cogeco proposes a "zone-based" approach to community programming. The proposal can be summarized as follows:

  Cogeco is also requesting various additions, amendments and/or deletions of certain conditions of licence on various undertakings. Further details are available in the application.
  In Broadcasting Public Notice CRTC 2007-31 dated 26 March 2007, the Commission announced an application by Cogeco to amend its licences of its cable broadcasting distribution undertakings serving various localities in Ontario and Quebec. Cogeco proposes a new condition of licence to be authorized to distribute, at its option, on a discretionary digital basis, the audio programming services offered by Canada's two satellite subscription radio undertakings. If this application is approved, Cogeco requests that this condition of licence be incorporated as part of this proposed regional licence.
