Follow-up to Telecom Decision 2006-34 - Reduced service intervals for Competitor Digital Network services

In this Decision the Commission approves new reduced service intervals for Competitor Digital Network services, where facilities are available, as proposed by MTS Allstream Inc., Saskatchewan Telecommunications, and TELUS Communications Company, and directs that the implementation date for these new reduced service intervals be within 60 days of the date of this Decision.

Introduction

In Telecom Decision 2006-34, the Commission finalized the service intervals for Competitor Digital Network (CDN) services and Type C loops that competitors acquire from the incumbent local exchange carriers (ILECs), where facilities are available. However, the Commission directed MTS Allstream Inc. (MTS Allstream), Saskatchewan Telecommunications (SaskTel), and TELUS Communications Company (TCC) to review, reduce, and refile, within one year of the date of that Decision, their service intervals for CDN services and Type C loops to align more closely with the service intervals of other ILECs.

On 25 May 2007, MTS Allstream, SaskTel, and TCC filed for approval new reduced service intervals for CDN services, where facilities were available. These companies did not propose service intervals for Type C loops, noting that this service had been destandardized. The record of this proceeding closed on 19 June 2007 with MTS Allstream's comments on SaskTel's and TCC's submissions.

The Commission considers that the parties' submissions raise the following issues:

The Commission notes that it has received and approved tariff applications1 during the past year from Bell Aliant Regional Communications, Limited Partnership (Bell Aliant), Bell Canada, MTS Allstream, SaskTel, and TCC to destandardize Type C loops. Since new installations of this service are no longer available to competitors, service intervals are no longer necessary for this service.

The Commission notes that MTS Allstream, SaskTel, and TCC, as requested, have provided revised service intervals for CDN services that are reduced from those they had proposed in the proceeding that led to Telecom Decision 2006-59 for all access and interexchange (IX) channels. The Commission considers that while the new reduced service intervals are not the same as those of Bell Aliant and Bell Canada, they are similar and hence reasonable.

The Commission therefore approves the new reduced service intervals for CDN services, where facilities are available, as submitted by MTS Allstream, SaskTel, and TCC. The Appendix summarizes all of the ILECs' service intervals for CDN services.

II. The appropriateness of the implementation dates for the new reduced service intervals

SaskTel proposed to introduce the new reduced service intervals within 60 days of a final decision from the Commission.

TCC submitted that it was prepared to implement the new reduced service intervals on 1 January 2008 due to the need for multiple systems upgrades and process amendments to support the provisioning of these services. TCC argued that these process upgrades and process amendments required code changes, testing, securing release windows for implementation, training, and final implementation. TCC added that it needed to make adjustments to equipment supplier processes.

MTS Allstream noted that its new reduced service intervals would become effective 1 June 2007. With respect to the submissions of SaskTel and TCC, MTS Allstream argued that any delay beyond 1 June 2007 for the implementation of new CDN service intervals was unacceptable as the Commission had provided the ILECs one year to comply with its directive in Telecom Decision 2006-34.

The Commission recognizes that the ILECs need to complete upgrades to provisioning systems and adjustments to supply processes in order to implement the new reduced service intervals. However, the Commission notes that it has already provided SaskTel and TCC with one year's notice to do so. The Commission considers that one year's notice was sufficient time to undertake preliminary planning and to finalize any required adjustments.

However, the Commission is of the view that, notwithstanding that MTS Allstream has already implemented the new CDN service intervals, SaskTel's request for 60 days after the date of this Decision to implement the new reduced service intervals is reasonable, given that the parties could not foresee the timing of the Commission's final determination on this issue.

Accordingly, the Commission directs SaskTel and TCC to implement the new reduced service intervals for CDN services no later than 60 days from the date of this Decision.
