Destandardization of Type C Local Loop service

The Commission received an application by TELUS Communications Company (TCC), dated 1 March 2007, proposing revisions to the former TCI Carrier Access Tariff (CAT) item 215, Local Network Interconnection and Component Unbundling, and the former TCBC CAT item 105, Local Network Interconnection and Component Unbundling, to destandardize Type C Local Loop service. In support of its application, TCC provided the information required by the Commission in New procedures for disposition of applications dealing with the destandardization and/or withdrawal of tariffed services, Telecom Circular CRTC 2005-7, 30 May 2005 (Circular 2005-7), including a copy of the notice sent to affected customers.

TCC submitted that Type C Local Loop service was provided at the same rates, terms, and conditions specified in TCC CAT item 224, Competitor Digital Network (CDN) Services for DS-1 Access. TCC noted that Type C local loops had become redundant as there was no difference between a Type C local loop and a CDN Access at DS-1 speed. TCC noted that Type C local loops did not support interexchange traffic and must be co-located in the central office that served that customer's end-user. TCC submitted that it incurred incremental costs to support the Type C Local Loop service relative to CDN DS-1 Accesses. TCC submitted that, given the functional similarities between these services, it was proposing to destandardize Type C Local Loop service, effective 22 May 2007. TCC indicated that it was not proposing to withdraw this service at this time.

The Commission received no comments on this application.

The Commission notes that, under the company's proposal, new installations, moves, rearrangements, or other changes to this service will no longer be allowed, but that existing customers will continue to receive the service. The Commission further notes that customers wishing to expand their Type C Local Loop service can do so by using CDN service at DS-1 speed, as applicable. The Commission considers that CDN service at DS-1 speed is an acceptable substitute for Type C Local Loop service in terms of functionality, cost, and geographical location.

The Commission notes that similar applications by Bell Aliant Regional Communications, Limited Partnership (Tariff Notice 23) and Bell Canada (Tariff Notice 6971) to destandardize Type C local loops were approved on 1 November 2006 in Telecom Order CRTC 2006-294 and Telecom Order CRTC 2006-295, respectively.1 In these Orders, the Commission considered that CDN and Digital Network Access services at DS-1 speed were acceptable as substitute services.

The Commission finds that TCC has fulfilled the customer notification and evidentiary requirements of Circular 2005-7. Further, the Commission considers that the impact of the destandardization of Type C Local Loop service on existing customers would be minimal. Therefore, the Commission considers that TCC's proposal to destandardize this service is reasonable.

In light of the above, the Commission approves TCC's proposal to destandardize Type C Local Loop service, effective the date of this Order.
