CKOL-FM Campbellford and its transmitter CKOL-FM-1 Madoc - Licence renewal

The Commission renews the broadcasting licence for the English-language Type B community radio programming undertaking CKOL-FM Campbellford and its transmitter CKOL-FM-1 Madoc, from 1 September 2007 to 31 August 2011. This short-term licence renewal will permit the Commission to review, at an earlier date, the licensee's compliance with the Radio Regulations, 1986.

The application

The Commission received an application by the Campbellford Area Radio Association (Campbellford) to renew the broadcasting licence for the English-language, Type B community radio programming undertaking CKOL-FM Campbellford and its transmitter CKOL-FM-1 Madoc. The licence expires 31 August 2007.

The Commission did not receive any interventions in connection with this application.

Non-compliance
|

On 20 January 2005, the Commission asked the licensee to provide it with logger tapes and other related material relating to the programming broadcast by CKOL-FM during the week of 9 to 15 January 2005.

The Commission analyzed the programming broadcast on CKOL-FM during the week of 9 to 15 January 2005, determining that only 24.9% of all category 2 musical selections broadcast by the licensee during that period were Canadian musical selections. This constituted an alleged violation of subsection 2.2(8) of the Radio Regulations, 1986 (the Regulations), which stipulates that:

2.2(8) Except as otherwise provided under a licensee's condition of licence that refers expressly to this subsection and subject to subsection (6), an A.M. or F.M. licensee licensed to operate a commercial station, community station or campus station shall, in a broadcast week, devote 35% or more of its musical selections from content category 2 to Canadian selections broadcast in their entirety.

In a letter dated 5 May 2005, the Commission advised the licensee of its apparent non-compliance with section 2.2 (8) of the Regulations regarding its Canadian content level for category 2 music.

In a letter dated 23 January 2007, the licensee advised the Commission that, consistent with the provisions of the Community Radio Policy, Public Notice CRTC 2000-13, 28 January 2000, CKOL-FM's programming targets primarily the needs and interests of the local community, and speculated that the Commission may have had difficulties in recognizing local Canadian music talent. The licensee also provided additional details of musical selections excluded from the Commission's original Canadian content calculations due to a lack of information.

On 29 January 2007, the Commission advised the licensee that, after adding selections proven to qualify as Canadian, the level of Canadian content music for the week of 9 to 15 January 2005 was found to be 27.1 %, which was still lower than the 35% requirement for category 2.

Commission's analysis and determination

Based on its review of this licence renewal application and the licensee's past performance, and given that this infraction represents the licensee's first non-compliance, the Commission determines that it is appropriate to renew the licence for a short term of four years, in accordance with Practices regarding radio non-compliance, Circular No. 444, 7 May 2001. This short-term licence renewal will enable the Commission to assess at an earlier date, the licensee's compliance with the Regulations and the station's conditions of licence.

Accordingly, the Commission renews the broadcasting licence for the English-language, Type B community radio programming undertaking CKOL-FM Campbellford and its transmitter CKOL-FM-1 Madoc, from 1 September 2007 to 31 August 2011.

CKOL-FM will be subject to the conditions set out in the New licence form for community radio stations, Public Notice CRTC 2000-157, 16 November 2000, as well as to the following condition:

The licensee shall devote, in each broadcast week, 12% or more of its musical selections from content category 3 (Special interest music) to Canadian selections broadcast in their entirety.

Employment equity
|

The Commission considers that community radio stations should be particularly sensitive to employment equity issues in order to reflect fully the communities they serve. It encourages the licensee to consider these issues in its hiring practices and in all other aspects of its management of human resources.
