Co-location power service rates and housekeeping changes

The Commission received an application by Bell Aliant Regional Communications, Limited Partnership (Bell Aliant), dated 15 September 2006 and amended 21 September 2006, proposing revisions to several General Tariff, Access Services Tariff and Special Facilities Tariff items to bring them in line with the corresponding Bell Canada tariffs. These tariff items are set out in the Appendix to this Order.

In its application, Bell Aliant proposed to reflect the application of the inflation factor minus productivity offset (I-X) constraints as directed in Regulatory framework for second price cap period, Telecom Decision CRTC 2002-34, 30 May 2002, as amended by Telecom Decision CRTC 2002-34-1 dated 15 July 2002 (Decision 2002-344), and to implement the price changes as directed in Bell Canada and TCC - Co-location power service rates, Telecom Decision CRTC 2006-42, 30 June 2006, as amended by Telecom Decision CRTC 2006-42-1 dated 25 August 2006.

Bell Aliant noted that the proposed rates had been charged coincident with the effective date stipulated in Decision 2002-34. In addition to seeking approval of these rates, Bell Aliant sought Commission ratification, pursuant to subsection 25(4) of the Telecommunications Act (the Act), for the charging of the rates for these services by Bell Aliant prior to the date of the Commission's approval.

In Telecom Order CRTC 2006-251, 28 September 2006, the Commission granted interim approval to Bell Aliant's application.

The Commission received no comments with respect to this application.
|

The Commission notes that the proposed rates, terms and conditions in Bell Aliant's applications are identical to those in Bell Canada's tariffs for the same services and considers this to be appropriate. The Commission also notes that the rates in Bell Canada's General Tariff item 5400 - Asymmetric Digital Subscriber Line (ADSL) Access Service, Access Services Tariff item 110 - Co-Location Arrangements for Interconnecting Canadian Carriers and Digital Subscriber Line Service Providers (DSLSP), and Access Services Tariff item 122 - Ethernet CO Connecting Link Arrangements are the subject of ongoing proceedings and remain interim.

Paragraph 25(4)(a) of the Act provides that:

25. (4) Notwithstanding subsection (1), the Commission may ratify the charging of a rate by a Canadian carrier otherwise than in accordance with a tariff approved by the Commission if the Commission is satisfied that the rate

(a) was charged because of an error or other circumstance that warrants the ratification;

Given that the rates charged by Bell Aliant are identical to Bell Canada's tariffed rates, the Commission considers that it would be appropriate to ratify the charging of these rates for the period between the establishment of the company1 and the date this application was granted interim approval.

In light of the above, the Commission approves on a final basis Bell Aliant's proposed revisions to its General Tariff, Access Services Tariff, and Special Facilities Tariff, with the exception of the rates for ADSL Access Service, Co-Location Arrangements for Interconnecting Canadian Carriers, and Ethernet CO Connecting Link Arrangements, which shall remain interim. The Commission ratifies, pursuant to subsection 25(4) of the Act, the charging of the proposed rates for the period between 7 July 2006 and 28 September 2006.
