In a Commission letter dated 29 September 2006, all requests for public disclosure and for further responses were addressed with the exception of the Consumer Group's request for disclosure of the information requested in interrogatory MTS Allstream(Consumer Groups)8Aug06-15 [Interrogatory 15].   The Commission letter indicated that this request for disclosure would be dealt with shortly by way of a separate process.

The purpose of this letter is to provide all parties with an opportunity to provide their views on the Consumer Groups' request for disclosure, in confidence and only to themselves, of the information requested in Interrogatory 15.

In Interrogatory 15, the Consumer Groups requested that MTS Allstream Inc. (MTS Allstream) provide copies of all studies conducted by, or on behalf of, MTS Allstream which address substitution of voice over Internet Protocol (VoIP) offered by third party providers (eg: Vonage) for MTS Allstream's circuit-switched telephony.  

In their letter dated 13 September 2006 , the Consumer Groups requested that the requested information be placed on the public record.   Alternatively, they also indicated their willingness to access the information in confidence pursuant to a non-disclosure agreement with MTS Allstream.

In a letter dated 20 September 2006 , MTS Allstream objected to the release of the requested information pursuant to a non-disclosure agreement.

The Commission has dealt with requests for disclosure to a specific party or parties on a case-by-case basis (see, for example, the Commission letter dated 23 March 1995 - Requirement to Answer LECOM Interrogatories - Telecom Public Notice CRTC 94-58, Implementation of Regulatory Framework ( 29 December 1994 ) and the Commission letter dated 1 September 2005 - Telecom Public Notice CRTC 2005-2, Forbearance from regulation of local exchange services (28 April 2005)).   For ease of reference, copies of these letters are attached.

MTS Allstream has not provided the Commission with the specific information at issue. MTS Allstream is to provide to the Commission, in confidence, the information requested in Interrogatory 15 no later than 12:00 PM (EST) Friday, 6 October 2006.  

The Consumer Groups are to provide further support for their request for confidential disclosure, only to themselves, of the information requested in Interrogatory 15 pursuant to a non-disclosure agreement with MTS Allstream. This submission is to be filed with the Commission and served on other parties no later than 12:00 PM (EST) Friday, 6 October 2006.  

Other parties, including MTS Allstream, can provide their views on the appropriateness of this request, based on the circumstances of this case.   These submissions are to be filed with the Commission and served on all parties no later than Tuesday, 10 October 2006.

All submissions should be received, and not merely sent, by the specified dates.

When filing their submissions, parties are to simultaneously provide a courtesy copy of their submissions to Rachelle Frenette at the following address: rachelle.frenette@crtc.gc.ca
