Re: Framework for forbearance from regulation of high-speed intra-exchange digital services , Telecom Public Notice CRTC 2005-8, as amended by Public Notice 2005-8-1 and Public Notice 2005-8-2

In a letter filed with the Canadian Radio-television and Telecommunications Commission (the Commission) on 13 September 2006, TELUS Communications Company (TCC) requested that the Commission forward the supplemental interrogatories set out in a Commission letter dated 1 September 2006 to additional companies operating in TCC's territory.

TCC submitted that it was clear from the supplemental interrogatories posed, that the Commission is collecting information to evaluate the state of competition across the country but that no western based cable or municipal electrical utility companies have been solicited for information. TCC further submitted that the supplemental information sought by the Commission extended the scope of the proceeding beyond an evaluation of competition in Bell Canada's territory.

Commission staff considers that the information sought by the supplemental interrogatories posed to all parties including TCC will be sufficient to enable the Commission to assess the state of competition in high-speed intra-exchange digital services in Canada in order to establish a forbearance framework. Commission staff notes that the more detailed information, such as the information sought in Bell Canada 's territory, is being sought in order to enable the Commission to make a determination with respect to Bell Canada's forbearance application. Commission staff considers, therefore, that this detailed information is not required for territories outside of Bell Canada's territory at this time.
