Framework for forbearance from regulation of high-speed intra-exchange digital services

In this Public Notice, the Commission revises the timelines for the above proceeding.

The Commission received a letter from MTS Allstream Inc. (MTS Allstream) dated 11 July 2005 requesting that the Commission extend the deadlines in Framework for forbearance from regulation of high speed intra-exchange digital service, Telecom Public Notice CRTC 2005-8, 30 June 2005 (Public Notice 2005-8) by sixty days.

The Commission received comments in support of MTS Allstream's request from Quebecor Média Inc. and TELUS Communications Inc. Bell Canada filed comments in opposition to MTS Allstream's request and proposed instead a schedule which extended the original close of record by 4 weeks.

In its reply comments MTS Allstream provided a revised timeline which extended the original close of record date by 6 weeks.

The Commission has carefully considered the views of all parties. The Commission considers that while it is important to complete this process and issue a decision in a timely fashion, it is equally important that all parties be given a sufficient opportunity to prepare their submissions. In light of these concerns, the Commission finds that MTS Allstream's revised timeline, with two adjustments, represents a good balance between the need for timeliness and the need to provide parties with proper preparation time. The adjustments are required to allow interested parties sufficient time to prepare interrogatories after receipt of parties' comments. The Commission considers that the 6-week extension from the original close of record date does not represent a significant delay to the process initiated by Public Notice 2005-8.

Accordingly, the timelines set out in Public Notice 2005-8 are hereby revised as follows:

Bell Canada is to file with the Commission, serving a copy on all parties, by 1 September 2005 any updates to its Part VII application for forbearance of intra-exchange HSDS.

Parties are invited to file written comments with the Commission with respect to the issues described in this Public Notice, serving a copy on all other parties, by 22 September 2005. Each submission is to include a table of contents and the portion of the submission that addresses the matters identified as issues 1 to 7 in paragraph 17 is to be structured as described in that paragraph. Parties are to include with their comments any supporting evidence, including any research studies or other material to which they wish to refer in this proceeding.

Any members of the public who wish to file written comments, without receiving copies of the various submissions, may do so by submitting their comments in writing to the Commission by 22 September 2005.

The Commission and the parties may address interrogatories to the parties identified in paragraph 20and to any party who filed comments pursuant to paragraph 24. Any such interrogatories must be filed with the Commission and served on the party in question by 14 October 2005.

Responses to these interrogatories are to be filed with the Commission and served on all parties by 3 November 2005.

Requests by parties for further responses to their interrogatories, specifying in each case why a further response is both relevant and necessary, and requests for public disclosure of information for which confidentiality has been claimed, setting out in each case the reasons for disclosure, must be filed with the Commission and served on the relevant party or parties by 10 November 2005.

Written responses to requests for further responses to interrogatories and for public disclosure must be filed with the Commission and served on the party or parties making the request by 25 November 2005.

A determination with respect to requests for further information and for public disclosure will be issued as soon as possible. Any information to be provided pursuant to that determination must be filed with the Commission and served on all parties, by 9 December 2005.

15.

All parties may file final argument with the Commission on matters within the scope of this proceeding, serving a copy on other parties by 23 December 2005.

Parties may file reply comments with the Commission, serving a copy on all other parties by 13 January 2006.
