Re: Review of price cap framework, Telecom Public Notice CRTC 2006-5, 9 May 2006 - Information required regarding the oral hearing

In order to assist in organizing and preparing for the oral hearing phase of the proceeding initiated by Review of price cap framework , Telecom Public Notice CRTC 2006-5, 9 May 2006 (Public Notice 2006-5), the information listed below is required. The information should be received, not merely sent, by the dates specified. It is expected that the Commission will issue a decision on the organization and conduct of the oral hearing in September.

Intention to appear

On 11 August 2006, parties notified the Commission whether they intended to appear at the oral hearing. In addition, parties are now requested to address the following:

Oral final argument

In Public Notice 2006-5, the Commission indicated that all parties wishing to file argument with the Commission on any matter within the scope of this proceeding do so by serving a copy on all other parties, by 26 October 2006. The Commission will also allow parties to make final oral argument. Consequently, parties are to state by 1 September 2006 whether they intend to present oral final argument.

Information relating to witnesses

Parties who have filed (or are filing) evidence and who intend to call witnesses should provide a list of the witnesses they intend to call, indicating:

(i) the subject matter of each witness' testimony;
(ii) the evidence and interrogatory responses for which each witness is responsible; and
(iii) the order in which it is proposed that the witnesses will be presented.

The parties are to indicate as well whether the witnesses will be appearing individually or in a panel, and if in a panel, the composition of the panel and the subject matter of the panel's testimony.

This information should be filed, with a copy served on all interested parties, by 8 September 2006.

Intention to cross-examine

Parties who intend to cross-examine one or more witnesses at the hearing should so advise the Commission by 13 September 2006 specifying, where possible, which witnesses (or subject-areas) they wish to have available for cross-examination.    It will be assumed that those who do not so advise do not intend to cross-examine witnesses.
