Aliant Telecom Inc.

Introduction of item 110, General regulations

The Commission received an application by Aliant Telecom Inc. (Aliant Telecom), dated 7 January 2005, to introduce General Tariff item 110, General Regulations, and to migrate the following tariff items from the four Aliant Telecom constituent companies into this new item:
 
  • Maritime Tel & Tel Limited's General Tariff CRTC 10001, items 3100, 3110, 3115, 3116, 3130 and 3140;
 
  • Island Telecom Inc.'s General Tariff CRTC 11001, items 12, 1800, 1815, 1816, 1830 and 1840;
 
  • NBTel Inc.'s General Tariff CRTC 12001, item 22; and
 
  • NewTel Communications Inc.'s General Tariff CRTC 13001, item 380.

Aliant Telecom proposed to remove from Tariff CRTC 12001, item 22.8, a rule which deals with suspension or termination of service when a customer had defaulted in making payment of any amounts due on accounts with charges for services purchased from other long distance service providers. The Commission notes that Terms of Service - Disconnection for partial payment of charges, Telecom Decision CRTC 2004-31, 11 May 2004, prohibits having such a rule.

Aliant Telecom also proposed to remove item 380.1 (a) from Tariff CRTC 13001, as this clause should have been removed when the inside wiring tariff was revised pursuant to Telecom Order CRTC 2002-228, 31 May 2002.

Finally, the company proposed to remove item 3100 (d) in Tariff CRTC 10001 and item 1800 (d) in Tariff CRTC 11001 since they apply to terminal equipment which is now forborne. Similarly, items 1830 and 1840 of Tariff CRTC 11001 and items 3130 and 3140 of Tariff CRTC 10001, Terminal Attachment Plan and Company Provided Interface, respectively, are being removed since they are also related to terminal equipment. All of these items should have been removed from Tariffs CRTC 10001 and CRTC 11001 just as they were from Tariffs CRTC 12001 and CRTC 13001 when terminal equipment was forborne.

The Commission notes that there are no changes to the rates.

The Commission received no comments with respect to the application.

7.

The Commission approves Aliant Telecom's application. The revisions take effect as of the date of this Order.
