Tina Hobday Re: Review and vary of Decisions 2003-58 and 2003-59 - Provision of fibre optic private networks Dear Ms. Hobday, The Commission received an application dated 24 October 2003 from Langlois Kronstr öm Desjardins on behalf of la Fédération des commissions scolaire du Québec, l'Association des commissions scolaires Anglophones du Québec, la société GRICS, le CRCD du Bas St-Laurent, la Commission scolaire du Pays-des-Bleuets and la Commission scolaire de la Riveraine (the Applicants) requesting that it review and vary Xit Télécom v. TELUS Québec - Provision of fibre optic private networks , Telecom Decision CRTC 2003.58, 22 August 2003, and Xit Télécom v. Bell Canada - Provision of fibre optic private networks , Telecom Decision CRTC 2003-59, 22 August 2003. In particular, the Applicants requested that the Commission treat customer specific arrangements (CSAs) relating to the "Villages branchés du Québec" program (the Program) as Type I CSAs and approve tariffs relating to the Program filed by Bell Canada, TELUS Québec [now TELUS Communications Inc. (TCI)], Télébec, société en commandite (Télébec) and any other incumbent telephone company involved in the Program. Staff notes that in Optical fibre service arrangements , Telecom Decision CRTC 2004-20, 23 March 2004 (Decision 2004-20), the Commission disposed of the Bell Canada TNs that were the subject of the Application. Decision 2004-20 also indicated that the relief sought by the Applicants with respect to the disposition of the TNs filed by companies other than Bell Canada in connection with the Program would be addressed separately. Staff notes that the Application touched upon two TCI TNs in connection with the Program, TNs 358 and 361. Staff further notes that TCI subsequently applied to withdraw these TNs and that the company's request was approved in Withdrawal of special facilities tariffs for optical fibre arrangements , Decision CRTC 2005-74, 23 February 2005 . With regard to Télébec, staff notes that in letters dated 29 March 2005, Télébec requested that TNs 302, 302A, 304 and 304A, that were the subject of the Application, be withdrawn as they no longer addressed the customer's needs. The Commission approved the withdrawals in Telecom Order CRTC 2005-134, 7 April 2005 . Accordingly, given that the TNs that were the subject of the Applicant's request have now either been disposed of or are no longer before the Commission, staff considers that the Applicant's review and vary application is now moot and will therefore be closing the file.
