Re: February Expedited Process - Organization and Conduct of the Oral Public Hearing

As indicated by Commission staff in letters dated 7 January 2005 concerning the above-noted process, the Commission will hold an oral public hearing on Friday, 25 February 2005 to adjudicate the following proceedings:

1.     Part VII application by Xit Télécom regarding the construction of a fibre optic network for the Commission scolaire de la Côte-du-Sud; and

2.     Part VII application by Union des consommateurs, the Public Interest Advocacy Centre and Option Consommateurs seeking CRTC intervention in the matter of dialers and modem hijacking.

The purpose of this letter is to provide information to the parties on a variety of matters relating to the organization and conduct of the hearing.

Order of the Proceedings
The attached agenda outlines the order and expected timing for each of the proceedings.

Responsibilities of the Parties
Parties are reminded that it is their responsibility to monitor the progress of the hearing.   Parties should keep themselves informed of the progress of the preceding matter on the Agenda, so that they will be ready to proceed with their matter if it concludes earlier or later than anticipated.

For ease of translation and transcription, parties are also requested to bring two copies of any written opening or closing remarks.

Filing of Documents
As indicated in the letters dated 7 January 2005, the parties should have filed a copy of all written material upon which they rely, except material already filed by the parties and Commission determinations, tariffs, tariff filings and any other similar documentation usually before the Commission in its normal course of business. Therefore, the Commission is not inclined to accept the filing of additional documents at the hearing.
