Community radio station in Shawinigan

1.

The Commission approves the application byLa radio campus communautaire francophone de Shawinigan inc. (La radio campus), licensee of CFUT-FM Shawinigan, for a broadcasting licence to operate a French-language Type B community FM radio programming undertaking in Shawinigan, Quebec. The station will operate at 91.1 MHz (channel 216A1) with an effective radiated power of 250 watts.

In New developmental campus radio station, Decision CRTC 2001-598, 20 September 2001,the Commission approved an application by Denis Benoît, on behalf of a company to be incorporated and now known as La radio campus communautaire francophone de Shawinigan inc., for a broadcasting licence to operate a developmental French-language campus FM radio programming undertaking in Shawnigan. Consistent with its approach for developmental community radio stations set out in Community Radio Policy, Public Notice CRTC 2000-12, 28 January 2000 (Public Notice 2000-12), the Commission issued a licence for a period of three years. Taking into consideration the 12 month period allowed to implement a new radio station, the licence was to expire 20 September 2005.1

In Public Notice 2000-12, the Commission stipulated that licensees interested in continuing the operation of their developmental campus radio stations are expected to file an application with the Commission for a regular campus radio licence or to cease operations. La radio campus informed the Commission that it wished to continue to operate CFUT-FM beyond this term and filed the current application for a regular broadcasting licence. However, the licensee stated in its application that it wished to obtain a licence for a regular French-language Type B community FM radio programming undertaking in view of the entire community's involvement in its community radio project and the fact that CFUT-FM no longer fits the profile of a campus station.
 

Programming

The station will broadcast 126 hours of programming during each broadcast week, with a minimum of 120 hours devoted to station-produced programming. The remaining 6 hours will be devoted to acquired programming featuring Francophone country music and religion.

Local programming will reflect the needs and interests of the community and will include local and regional news, sports, weather, current events, features, and emergency broadcast services.

The Commission notes that the applicant indicated that, in each broadcast week, it would broadcast religious programming as defined in the Religious Broadcasting Policy, Public Notice CRTC 1993-78, 3 June 1993 (Public Notice 1993-78).  The Commission considers that, when the applicant offers religious programming as defined in Public Notice 1993-78, it must adhere to the guidelines set out in that public notice with respect to the provision of balance (section III.B.2.a) and ethics (section IV).  The Commission is imposing a condition of licence, as set out in the appendix to this decision, requiring that, when the applicant broadcasts such religious programming, it must adhere to these guidelines.

The applicant will continue to recruit volunteers for the station through on-air solicitation and through various other media. The applicant will ensure that volunteers are trained by the full-time staff to ensure strict compliance with the Community Radio Policy, Public Notice CRTC 2000-13, 28 January 2000 (Public Notice 2000-13).

The new station will develop local talent by providing promotional services through organizing contests and concerts.
 

Interventions

The Commission received interventions in support of this application.
 

Issuance of the licence

In accordance with Public Notice 2000-13, the licence for this community radio station will be granted to La radio campus communautaire francophone de Shawinigan inc., a not-for-profit organization without share capital, whose structure provides for membership, management, operation and programming by members of the community at large. The board of directors is ultimately responsible for compliance with the Radio Regulations, 1986 and the station's conditions of licence.

The licence will expire on 31 August 2012 and will be subject to the conditions set out in New licence form for community radio stations, Public Notice CRTC 2000-157, 16 November 2000, and to the condition of licence appended to this decision.

The Department of Industry (the Department) has advised the Commission that, while this application is conditionally technically acceptable, it will only issue a broadcasting certificate when it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.

The Commission reminds the applicant that, pursuant to subsection 22(1) of the Broadcasting Act, no licence may be issued until the Department notifies the Commission that its technical requirements have been met, and that a broadcasting certificate will be issued.

Furthermore, the licence for this undertaking will be issued once the applicant has informed the Commission in writing that it is prepared to commence operations. The undertaking must be operational at the earliest possible date and, in any event, no later than 24 months from the date of this decision, unless a request for an extension of time is approved by the Commission before 18 October 2007. In order to ensure that such a request is processed in a timely manner, it should be submitted at least 60 days before that date.
 

Employment equity

15.

The Commission considers that community radio stations should be particularly sensitive to employment equity issues in order to reflect fully the communities they serve. It encourages the licensee to consider these issues in its hiring practices and in all other aspects of its management of human resources.

Appendix to Broadcasting Decision CRTC 2005-501

 

Conditions of licence

 

1. The licence shall be subject to the conditions set out in New licence form for community radio stations, Public Notice CRTC 2000-157, 16 November 2000.

 

2. Where the licensee broadcasts religious programming as defined in the Religious Broadcasting Policy, Public Notice CRTC 1993-78, 3 June 1993, the licensee shall adhere to the guidelines set out in sections III.B.2.a) and IV of that public notice with respect to the provision of balance and ethics, as amended from time to time.
