Revised lists of eligible satellite services

In Call for comments on proposals for the addition of non-Canadian satellite services to the list of services eligible for digital distribution, Broadcasting Public Notice CRTC 2003-36, 11 July 2003, the Commission invited comments on three separate requests by Vidéotron ltée, Rogers Cable Inc., and the Canadian Cable Television Association, acting as Canadian sponsors, to add 15 non-Canadian satellite services to the Commission's lists of eligible satellite services, for distribution on a digital basis.

In Requests to add non-Canadian third-language services to the lists of eligible satellite services for distribution on a digital basis, Broadcasting Public Notice CRTC 2004-50, 15 July 2004 (Public Notice 2004-50), the Commission approves the addition of eight non-Canadian third-language services, consisting of five mainly Spanish-language services, one German-language service, one Romanian-language service, and one Arabic-language service. In Public Notice 2004-50, the Commission also denies requests to add six other non-Canadian third-language services. In Requests to add Al Jazeera to the lists of eligible satellite services for distribution on a digital basis, Broadcasting Public Notice CRTC 2004-51, 15 July 2004 (Public Notice 2004-51), the Commission approves the addition of the Arabic-language service Al Jazeera, subject to conditions set out in that public notice.

Accordingly, in this notice, the Commission sets out revised lists of eligible satellite services reflecting the determinations in Public Notices 2004-50 and 2004-51. These lists replace those contained in Revised lists of eligible satellite services, Broadcasting Public Notice CRTC 2003-43, 5 August 2003, and reflect the addition of nine non-Canadian third-language services to the lists of eligible satellite services for distribution on a digital basis.

In addition, for administrative reasons, a list of eligible satellite services authorized for digital distribution only has been added to the List of Part 2 Eligible Satellite Services (Appendix A, Section C, List of Part 2 Eligible Satellite Services for Digital Distribution Only), the List of Part 3 Eligible Satellite Services (Appendix B, List of Part 3 Eligible Satellite Services for Digital Distribution Only) and the List of DTH Eligible Satellite Services (Appendix C, Section C). These lists are referred to collectively as the "digital lists." The digital lists contain the same services as found in Appendix D,List of Part 2, Part 3, and DTH Eligible Satellite Services for Digital Distribution, which has been retained for convenience.

  Authorization for the services in Sections A and B is subject to the following:
  - In the case of signals received from a licensed SRDU, ASN, the CBC English- and French-language Television Services and foreign satellite services, licensees are required to enter into the necessary contractual arrangements for such carriage.
  - Licensees that distribute a PBS signal received at the local head end by terrestrial transmission may distribute one PBS service received from a licensed SRDU. All other licensees may distribute a maximum of two PBS services received from a licensed SRDU. Licensees may not distribute the signal of more than one affiliate of the same commercial U.S. network, received from a licensed SRDU, unless otherwise authorized pursuant to a condition of licence.

  - In the case of licensed television programming undertakings offering TVA or CTV programming, a licensee also distributing the signal of a local TVA or CTV affiliate shall delete the duplicate programming from the services received from a licensed SRDU or substitute the local service(s) when the programming is identical.
  - Licensees that distribute a PBS signal received at the local head end by terrestrial transmission may distribute one PBS service received from a licensed SRDU. All other licensees may distribute a maximum of two PBS services received from a licensed SRDU. Licensees may not distribute the signal of more than one affiliate of the same commercial U.S. network, received from a licensed SRDU, unless otherwise authorized pursuant to a condition of licence.

  When any of these lists of eligible satellite services are replaced by another list, the only authorized services will be those contained in the most recent list, accordingly these lists supersede the lists dated 5 August 2003.
