Call for comments on proposals for the addition of non-Canadian satellite services to the list of services eligible for digital distribution

 

Background

1. The Commission received requests from three separate Canadian sponsors for the addition of 15 non-Canadian satellite services to the list of satellite services eligible for digital distribution. A brief description of each service, as provided by the sponsor or sponsors, is set out in the appendix to this public notice, along with the name and address of each sponsor.
2. In Call for proposals to amend the lists of eligible satellite services through the inclusion of additional non-Canadian services eligible for distribution on a digital basis only,Public Notice CRTC 2000-173, 14 December 2000 (Public Notice 2000-173), the Commission invited proposals to amend the lists of eligible satellite services (the lists) through the inclusion of additional non-Canadian programming services that would be authorized for distribution on a digital basis only. The Commission also stated in Public Notice 2000-173 that any such requests must include the following:
 
  • evidence that the non-Canadian service has agreed to be sponsored by the Canadian party filing the proposal;
 
  • a statement from the service provider that it has obtained all necessary rights for distribution of its programming in Canada;
 
  • a brief description of the service;
 
  • a copy of the current program schedule;
 
  • evidence of potential demand, as gathered through discussions with distributors; and
 
  • an undertaking from the non-Canadian service provider that it does not hold, will not obtain, nor will it exercise, preferential or exclusive programming rights in relation to the distribution.
3. With respect to these requests for the addition of non-Canadian satellite services to the lists, the Commission is satisfied that the supporting information required by Public Notice 2000-173 has been provided and that it is appropriate to call for comments at this time. While one of the programming services, Eurochannel, has not yet obtained all of the rights required to distribute its programming in Canada, its sponsor indicated that, if the request is approved, Eurochannel will obtain all such rights before its signal is made available in Canada.
4. As stated in Public Notice 2000-173, the Commission intends to assess the current requests in the context of its general policy which, among other things, precludes the addition of new non-Canadian satellite services that can be considered either totally or partially competitive with Canadian specialty or pay television services.
5. In applying this policy, the Commission will take into account the descriptions of all specialty and pay television programming undertakings whose licence applications have been approved by the Commission to date. These include all analog specialty television and pay television services as well as the Category 1 and Category 2 specialty programming services approved in Decisions CRTC 2000-449 through 2000-731 and all other Category 2 services licensed to date.
 

Call for comments

6. Interested parties wishing to file comments on any of the sponsored non-Canadian services listed in the appendix to this public notice are invited to do so. Commenting parties should also submit a true copy of their comments to the appropriate Canadian sponsor, or sponsors if there is more than one for a given service, at the addresses provided in the appendix. Proof that comments have been sent to sponsors must accompany the original of the comments sent to the Commission.
7. Comments must be received by the CRTC and by the Canadian sponsors on or before 11 August 2003.
8. Parties should clearly identify the request or requests to which their comments apply. They should also indicate whether they support, oppose, or propose changes to the requests, and should include the facts and grounds therefor.
9. Sponsors may file a written reply to any comments received concerning their requests. Such replies should be filed with the Commission, and a copy sent to the person who submitted the comments, by no later than 11 September 2003.
10. The Commission will not formally acknowledge comments. It will, however, fully consider all comments and they will form part of the public record of the proceeding, provided that the procedures for filing set out below have been followed.
 

Procedure for filing comments

11. Interested parties can file their comments either electronically (i.e. by email) or on paper. Submissions longer than five pages should include a summary.
12. Parties wishing to file their comments electronically can do so by sending them to procedure@crtc.gc.ca.
13. Parties wishing to file their comments on paper should send them to the Secretary General, CRTC, Ottawa, K1A 0N2.
14. Please number each paragraph of your submission. In addition, please enter the line ***End of document*** following the last paragraph. This will help the Commission verify that the document has not been damaged during transmission.
15. The Commission will make comments filed in electronic form available on its web site at www.crtc.gc.ca but only in the official language and format in which they are submitted. Such comments may be accessed in the Public Proceedings section of the CRTC web site. Copies of all comments, whether filed on paper or in electronic form, will also be placed on the public examination file.
16. The Commission encourages interested parties to monitor the public examination file (and/or the Commission's web site) for additional information that they may find useful when preparing their comments.

1. Al Jazeera

Description of the service:
A privately owned programming service in Arabic produced in Qatar and broadcast to North America from Rome. This service specializes in news and discussion programs, including newscasts, talk shows, documentaries, scientific, sports and educational programs. It has correspondents in major Arab and world capitals.

2. Art Movies

Description of the service:

A privately owned programming service that is part of the Arab Radio and Television Network, with its headquarters in Saudi Arabia and production facilities spanning the entire Middle East. Art Movies offers Arabic-language programming from Egypt, Lebanon and different regions of the Middle East. It specializes in broadcasting movies, but also presents live events concerning the making of cinema, and celebrity interview shows focussing on Middle Eastern film stars.

3. Azteca 13 Internacional

Description of the service:

A privately owned programming service originating in Mexico, with general interest programming in the Spanish language, featuring sports, entertainment, childrens' programming, music, documentaries and soap operas.

4. Canal SUR

Description of service:

A privately owned programming service whose Spanish-language programming originates directly from independent broadcasters from a variety of Latin American countries. Programming consists of news, sports reports, talk shows, variety shows, children's programming and live coverage of events in Latin America such as elections and major news events.

5. Cine Latino

Description of service:

A programming service in Spanish offering commercial free programming consisting of Spanish or Latin American films from Mexico, Argentina, Spain, Columbia, Chile, Venezuela and Peru.

6. Eurochannel

Description of service:

A privately owned programming service originating from France with programming consisting mainly of films. The films shown are primarily from Spain, France, the UK and Italy, as well as those films that have participated in major European film festivals. The programming is shown in the language of its origination and subtitled in either Spanish or Portuguese. Other programming on this channel includes programs on fashion, travelogues, European design shows, and music programs from Europe.

7. German TV

Description of service:
A programming service jointly formed by the two major German public network broadcasters (ARD and EBU) and Germany's only international public broadcaster, Deutsche Welle. German TV provides general interest programming in German, including news and information programming, documentaries, sports, dramas, films, entertainment, variety, and children's programming.

8. Gol TV

Description of the service:

A privately owned programming service that broadcasts mostly soccer-related programming, including live broadcasts or rebroadcasts of over 800 games per year, as well as soccer-themed original programming consisting of talk shows, soccer news and interviews. The programming originates from Mexico, Spain, the United States and other countries where major league soccer games are played. The service offers 60% of its programming in Spanish and English, with Spanish on the primary audio track and English on the secondary audio track.

A programming service from Spain's public broadcaster offering Spanish-language original programming originating from Spain consisting of documentaries relating to nature, history, literature, travel, technology and science, biography, arts, and society.
