Telecom Order CRTC 2004-389

  Ottawa, 22 November 2004

TELUS Communications Inc.

  Reference: Tariff Notice 158

Maintenance of customer-provided equipment and agreement

The Commission received an application by TELUS Communications Inc. (TCI), dated 5 October 2004, to revise Special Facilities Tariff items 301 and 306 to 311, reflecting the migration of the existing non-mandated co-location special facilities services to the newly approved General Tariff item 405 Business Co-location offering.

With respect to Special Facilities Tariff item 301, Maintenance of Customer-Provided Equipment - Specific Customer Only, TCI stated that the service consists of a non-mandated co-location arrangement and a separate Operations, Administration and Maintenance (OA&M) Agreement. The company proposed to migrate the non-mandated co-location portion to the new General Tariff item 405 and continue the OA&M arrangement portion under the item 301 at existing approved conditions, rates and charges.

TCI also filed for approval an amendment to the OA&M Agreement which incorporated Commission requirements stipulated in Confidentiality provisions of Canadian carriers, Telecom Decision CRTC 2003-33-1, 11 July 2003 regarding confidentiality provision and associated customer consent, and Measures with respect to incumbent telephone company regulatory compliance, Telecom Public Notice CRTC 2003-4, 10 April 2003, regarding information required in business customer contracts.

The Commission received no comments with respect to the application.

The Commission approves TCI's application. The revisions take effect as of 28 November 2004.
