Interconnection rates |

The Commission received an application by Allstream Inc. (Allstream), now known as MTS Allstream Inc., dated 3 March 2004 and amended on 12 April 2004, to revise General Tariff item 201.2, Termination of Traffic from Exchanges within ILEC Local Calling Area, and item 302.2, Trunk-side Access, Switching and Aggregation. |

Allstream proposed changes to item 201.2, Termination of Traffic from Exchanges within ILEC Local Calling Area service in order to reflect the rates that were in effect for Bell Canada within Ontario and Quebec at 1 June 2002. |

Allstream proposed changes to item 302.2, Trunk-side Access, Switching and Aggregation service in order to reflect the adjustments made to the incumbent local exchange carriers (ILECs') Direct Connection rates approved in Direct Connection service, Telecom Decision CRTC 2003-83, 17 December 2003. The revised rates came into effect 17 December 2003. |

In its amended application, Allstream proposed to withdraw the revisions proposed to item 201.2, Termination of Traffic from Exchanges within ILEC Local Calling Area service. Allstream submitted that the proposed revisions were not required given that the rates approved in Telecom Order CRTC 2004-43, 10 February 2004 (Order 2004-43) conformed to the rates contained in competitive local exchange carrier (CLEC) Model Tariff version 21. |

The Commission received no comments with respect to the application. |

In Local competition, Telecom Decision CRTC 97-8, 1 May 1997, the Commission determined that it was in the public interest to require CLECs to provide interconnection to all interexchange service providers and wireless service providers, at terms and conditions that were equivalent to those contained in the ILECs' tariffs. The Commission required all CLECs to file proposed tariffs for interconnection, justifying any departure from the terms and conditions contained in the ILECs' tariffs. |

In Regulatory framework for second price cap period, Telecom Decision CRTC 2002-34, 30 May 2002, the Commission determined that all the ILECs' tariff rates would be made interim effective 1 June 2002, and that any rate changes approved by the Commission for an ILEC to meet its 2002 price cap commitment would be effective as of 1 June 2002. The ILECs' rates approved in Rates for co-location floor space, Direct Connection service, Wireless Access Service: Line-side Access services, and Wireless Service Providers Enhanced Provincial 9-1-1 Network Access service, Telecom Decision CRTC 2003-12, 18 March 2003, as amended by Telecom Decision CRTC 2003-12-1, 19 November 2003, and Rates for Competitor Services, Telecom Decision CRTC 2003-13, 18 March 2003, as amended by Telecom Decision CRTC 2003-13-1, 23 May 2003, and Telecom Decision CRTC 2003-13-2, 27 June 2003, became effective on 1 June 2002. |

The Commission notes that Allstream's proposed changes to Termination of Traffic from Exchanges within ILEC Local Calling Area are required in order to ensure that this service would have been provided at terms and conditions that were equivalent to those contained in the ILECs' tariff from 1 June 2002 to 31 May 2003. The Commission further notes that Allstream's rates approved in Order 2004-43 only came into effect on 1 June 2003. |

In light of the above, the Commission approves on an interim basis Allstream's application with the exception of the proposed amendment to item 201.2, Termination of Traffic from Exchanges within ILEC Local Calling Area. The proposed revisions to item 201.2, Termination of Traffic from Exchanges within ILEC Local Calling Area service take effect as of 1 June 2002. The proposed revisions to item 302.2, Trunk-side Access, Switching and Aggregation service take effect as of 17 December 2003. |
