  PREAMBLE
  PART A
  At the 7 June 2004 public hearing, the Commission will examine applications to renew the licences of the commercial radio programming undertakings listed as items 1 to 9 in this Notice of Public Hearing.
  Each of these applications gives rise to issues related to certain business arrangements entered into or being contemplated between broadcasters in certain markets across Canada. The business arrangements include the continuance of Local Management Agreements (LMAs), Local Sales Agreements (LSAs) or any other proposed business arrangement affecting two or more stations in a market.
  Taking into account the objective of fostering diversity of programming, independence of news voices in each of these markets, the Commission will examine the following:
 

i) The appropriateness of the proposed Sales Agreement in Charlottetown, as a result of the termination of the existing LMA;

 

ii) The appropriateness of the LSA in Sudbury;

 

iii) The rationale for continuance of the LMA in Thunder Bay;

 

iv) Appropriateness of the mutual arrangement in Halifax.

  The Commission may wish to investigate the possibility of requiring that specific mechanisms or safeguards be put in place to ensure that licensees continue to meet their regulatory obligations to the Commission at all times.
  The Commission may also choose to investigate the possibility of imposing conditions of licence in accordance with Section 11.1 of the Radio Regulations, 1986 for the purpose of permitting licensees to operate under certain business arrangements.
  All of the agreements relating to these arrangements have been placed on the public files relating to these applications.
  The Commission invites interested parties to comment on any issue.

  Application by NEWCAP INC. to renew the licence of the commercialradio programming undertaking CJLB-FM Thunder Bayexpiring 31 August 2004.
  CJLB-FM has been operated, since 1995, under a Local Management Agreement (LMA) with C.J.S.D. Incorporated (C.J.S.D.). Pursuant to the LMA, C.J.S.D. acts as the managing partner for its two stations CKPR and CJSD-FM (renewal applications 2003-1488-1; 2003-1489-9) and Newcap's station CJLB-FM.

  In a letter dated 24 July 2003, the Commission has notified the licensees of its intention to further examine this situation in the context of their licence renewals.

  Application by CJRN 710 INC. to renew the licence of the commercial radio programming undertaking CKEY-FM Fort Erie and its transmitter CKEY-FM-1 St. Catharines expiring 31 August 2004.
  The Commission originally announced this application in Streamlined renewals for radio programming and radio network undertaking licences due to expire in 2003, Broadcasting Public Notice CRTC 2002-68 (PN 2002-68), dated 5 November 2002. All applications listed in Public Notice CRTC 2002-68 were received and processed pursuant to the revised procedures announced in Broadcasting Circular CRTC 2002-448 (the Circular) entitled The CRTC Streamlines Radio Renewals Process.
  The Commission received an intervention in response to the renewal application by CJRN 710 Inc. alleging that the applicant's programming originates from a studio located in Buffalo, New York. As a result of this intervention, and in accordance with the procedures described in the Circular, the Commission withdrew the application from PN 2002-68 and requested additional information from the licensee.
  The Commission subsequently republished for public comment the application to renew the licence for CKEY-FM Fort Erie and its transmitter CKEY-FM-1 St. Catharines in Broadcasting Public Notice CRTC 2003-22.
  In response, the Commission received additional interventions from two parties alleging an American orientation in the programming of the station and a dependent relationship with an American broadcaster for its programming.
  The Commission therefore requested, and received from the licensee, additional documentation about the licensee's relationship with an American broadcaster. The Commission has also completed an analysis of the logger tapes and other materials supplied by CKEY-FM pertaining to the week of 16-22 November 2003.
  As a result of this analysis, the Commission intends to discuss with the licensee at the public hearing its compliance with condition of licence number 9, which requires the applicant to "refrain from soliciting or accepting local advertising for broadcast during any broadcast week when less than one-third of the programming aired is local".
  The definition of local programming states, in part: In their local programming, licensees must include spoken word material of direct and particular relevance to the community served, such as local news, weather and sports, and the promotion of local events and activities.
  The Commission will wish to discuss with the licensee its compliance with subsections 8(1) and 8(4) of the Radio Regulations, 1986 concerning program logs, paragraph 9(3)(b) regarding a music list, and subsections 2.2(8) and 2.2(9) concerning the broadcasting of Canadian musical selections, during the broadcast week between 6 a.m. and 6 p.m. Monday to Friday.
  The Commission will also wish to discuss with the licensee whether, at any time during the period of the current licence, the undertaking or its programming was not under control of the licensee.
  Please note that the Commission will consider the interventions already received, accepted and filed on the public file for Broadcasting Public Notices CRTC 2002-68 and 2003-22, respectively, as well as any other intervention received in the context of this proceeding.

  The new station would operate on frequency 95.5 MHz (channel 238A) with an effective radiated power of 5,660 watts (non-directional antenna/antenna height 38.7 metres).
  The transmitter in Goderich would operate on frequency 99.7 MHz (channel 259A) with an effective radiated power of 1,670 watts (non-directional antenna/antenna height 53.8 metres).
  The transmitter in Port Elgin would operate on frequency 97.9 MHz (channel 250A) with an effective radiated power of 1,620 watts (non-directional antenna/antenna height 56.8 metres).
  The applicant is proposing an Adult Classic Hit format.
  This application is technically mutually exclusive with an application by Bayshore Broadcasting Corporation (2004-0031-7), which will also be heard at this hearing. The technical mutual exclusivity is with respect to the proposed Port Elgin transmitter.

  Application by BAYSHORE BROADCASTING CORPORATION for a licence to operate an English-language commercial FM radio programming undertaking in Port Elgin.
  The new station would operate on frequency 97.9 MHz (channel 250B1) with an average effective radiated power of 3,800 watts (maximum effective radiated power of 7,600 watts/antenna height of 137.5 metres).
  The Commission notes that the applicant is presently licensed to operate the radio programming undertaking CFOS Owen Sound with a transmitter, CFPS at Port Elgin.
  The applicant indicates that the new FM station would replace its transmitter CFPS Port Elgin and that, should its application be approved, it would cease the operation of CFPS Port Elgin following the implementation of the new FM station.
  The proposed FM undertaking would operate as a full service English-language commercial FM station programming an Adult Contemporary format.
  This application is technically mutually exclusive with an application by Brian Cooper and Daniel McCarthy, on behalf of a corporation to be incorporated (application 2003-0464-2), which will also be heard at this hearing. The technical mutual exclusivity is with respect to the proposed Port Elgin transmitter.
  The Commission will only proceed with this application at the public hearing if advised by the Department of Industry, at least twenty days prior to the hearing, that it is technically acceptable.

  Application by the CANADIAN BROADCASTING CORPORATION (CBC) to acquire the assets of the radio programming undertaking CHLM-FM Rouyn-Noranda and its transmitter CHLM-FM-1 Amos/Val D'Or.
  The applicant is also requesting a licence to continue the operation of the undertaking, upon surrender of the current licence issued to Radio Nord Communications inc.
  The CBC indicates that since February 2000, CHLM-FM fully rebroadcasts the CBC's regional and network programming. Radio-Nord does not broadcast any local programming on this station.
  The CBC indicates that the station will produce 27 hours 30 minutes per week of local programming. The remainder of its programming will be from its network La Première Chaîne received from CBF-FM Montréal.

  The licensee proposes the following amendments:
 

- amendment of the condition relating to Canadian content in order to measure it over the broadcast year rather than the broadcast semester;

 

- addition of a condition stating that not less than 75% of the programming broadcast on VisionTV shall be from unrelated production companies;

 

- decrease in the minimum Canadian content during the evening broadcast period from 60% to 50%;

 

- increase in the minimum Canadian content during the broadcast day from 60% to 65%;

 

- increase in the Canadian program expenditure requirement from 45% of previous year gross revenues plus an additional 25% of revenue from 2 cents of the wholesale rate, to 47% of previous year gross revenues plus an additional 25% of revenue from 2 cents of the total wholesale rate; and

 

- increase in the maximum wholesale rate from $0.10 to $0.12, with the stipulation that Canadian program expenditure requirement shall be 47% of previous year gross revenues plus an additional 25% of the revenues generated from 4 cents of the wholesale rate.

  Following Broadcasting Notice of Public Hearing CRTC 2003-12, the Commission is presently considering an application by VisionTV (2003-1462-5) concerning a corporate reorganization.
  The Commission will examine the apparent non-compliance of the licensee with respect to the condition of licence requiring it to devote 90% of its programming to category 4 (Religion).
