Re: PN 2004-2, Request from Microcell Telecommunications Inc. to amend procedures

The Commission received a letter dated 23 July 2004 from Microcell Telecommunications Inc. (Microcell) requesting extensions to the following deadlines for the above-named proceeding:

On 23 July 2004, Commission staff issued a letter to parties inviting comment on Microcell’s request. The following parties supported Microcell’s request to amend the process:

No parties opposed Microcell’s request.

Microcell’s request is considered to be reasonable given the public interest in establishing as complete a record as possible for PN 2004-2, subject to the minor modifications to the deadline dates as set out below.

Accordingly, the process as set out in PN 2004-2, as amended by paragraph 34 of the Commission’s letter dated 22 April 2004, is further amended as follows:

Paragraph 34 

b) Responses to those interrogatories are to be filed with the Commission and served on all parties, by11 August 2004.

c) Requests by parties for further responses to their interrogatories, specifying in each case why a further response is both relevant and necessary, and requests for public disclosure of information for which confidentiality has been claimed, setting out in each case the reasons for disclosure, must be filed with the Commission and served on the relevant party or parties by 16 August 2004.

d) Written responses to requests for further responses to interrogatories and for public disclosure must be filed with the Commission and served on the party or parties making the request by 23 August 2004.

A determination with respect to requests for further information and for public disclosure will be issued as soon as possible. In addition, parties are advised that any information to be provided pursuant to that determination must be filed with the Commission and served on all parties, will remain, by 15 September 2004.

Parties are reminded that documents must be received, and not merely sent, by the dates indicated.
