  Application by TVA GROUP INC. (TVA), on behalf of CANAL ÉVASION INC. (CE), to amend the licence of the French-language specialty television programming service known as Canal Évasion.
  TVA proposes to delete the condition of licence relating to the shareholdings of TVA in CE, which reads as follows:
 

"2. Any transaction increasing TVA Group Inc.'s ownership of Canal Évasion to more than 10% of voting shares cannot proceed without the prior approval by the Commission."

  TVA asked that the foregoing condition of licence be deleted, since it has become redundant following the Commission's Public Notice CRTC 2002-24 (dated 9 May 2002), amending the Commission's regulations to remove the 10% restriction imposed on cable ownership of analog discretionary services by deleting s. 10(4)(d) of the Specialty Services Regulations, 1990 and s. 6(4)(d) of the Pay Television Regulations, 1990.

  Application by CHAU-TV COMMUNICATIONS LTÉE to amend commitments concerning tangible benefits made pursuant to the transfer of ownership as set out in Public Notice CRTC 2001-2, 5 January 2001.
  The licensee proposes to change some of its programming commitments, which now reads:
 

The Commission notes the applicant's commitment relating to the offer of tangible benefits which represent 10% of the transaction's value, in accordance with the policy set out in Public Notice CRTC 1999-97. The benefit payments of $700,000 will be averaged over a period of seven years and will be paid to independent producers working in regions outside of Montreal, specifically, Eastern Quebec and New Brunswick (Public Notice CRTC 2001-2, 5 January 2001).

The licensee would reallocate $295,000 of the amounts designated for new Canadian production to purchase a mobile production vehicle and build microwave links between Baie-St-Paul and Rivière-du-Loup, and between Caraquet and Carleton.

  In support of its application, the licensee cites the size of the territories covered by CHAU-TV Carleton, CKRT-TV and CIMT-TV Rivière-du-Loup, and notes that the news reports produced by those stations are broadcast 24 hours later by the smaller stations because they have to be physically transported by bus or boat. Microwave links would be useful for the Caraquet and Baie-St-Paul regions, which are most affected by the situation.
  The licensee also submits that with a mobile unit, it would be able to improve its reporters' reaction time, and that although these amendments would significantly alter its commitments with respect to new Canadian production, they would provide a daily and lasting benefit to the people of Charlevoix County and the Acadian community of Northern New Brunswick.
  The licensee believes that these amendments would improve the quality of news offered to the public by offering same-day broadcasts (via microwave links) and improving reporters' reaction time (mobile production vehicle).
  The Commission notes, however, that the approval of this application would considerably reduce the amount invested in Canadian regional independent production.
