General Tariff - Interconnection rates

The Commission received an application by Microcell Solutions Inc. (Microcell), formerly Microcell Connexions Inc., dated 16 July 2003, and amended on 14 August 2003, for approval of revised rates that reflect the Commission's determinations in Rates for co-location floor space, Direct Connection service, Wireless Access Service: Line-side Access services, and Wireless Service Providers Enhanced Provincial 9-1-1 Network Access service, Telecom Decision CRTC 2003-12, 18 March 2003 (Decision 2003-12) and Rates for competitor services, Telecom Decision CRTC 2003-13, 18 March 2003 (Decision 2003-13). Microcell's application also reflects the company's name change.

Microcell requested that the effective date of the proposed changes be 1 June 2002.

The Commission received no comments with respect to the application.
|

In Local competition, Telecom Decision CRTC 97-8, 1 May 1997 (Decision 97-8), the Commission determined that it was in the public interest to require competitive local exchange carriers (CLECs) to provide interconnection to all interexchange service providers and wireless service providers, at terms and conditions that are equivalent to those contained in the incumbent local exchange carriers' (ILECs') tariffs. The Commission required all CLECs to file proposed tariffs for interconnection, justifying any departure from the terms and conditions contained in the ILECs' tariffs.

The Commission notes that in Regulatory framework for second price cap period, Telecom Decision CRTC 2002-34, 30 May 2002 (Decision 2002-34), the Commission determined that all ILECs' tariff rates be made interim effective 1 June 2002, and that any rate changes approved by the Commission to meet the 2002 price cap commitment would be effective as of 1 June 2002. The rates approved in Decisions 2003-12 and 2003-13 reflect ILECs rates that are effective 1 June 2002.

In light of the above, the Commission approves on an interim basis, Microcell's proposed rates which take effect 1 June 2002. Further, the Commission also approves Microcell's application effective the date of this order.

The Commission notes that in Decision 2002-34, each ILEC was directed to issue tariff pages by 1 June of each year, beginning in 2003, incorporating adjustments to Category I Competitor Service rates to reflect the application of the I-X constraint.

The Commission further notes that in Call Routing - Location Routing Number Absent, Telecom Order CRTC 2003-50, 27 January 2003 (Order 2003-50), and in Amalgamation of the basic listing interchange file service, Telecom Order CRTC 2003-136, 31 March 2003 (Order 2003-136), the Commission approved amalgamated rates applicable to TELUS Communications Inc.'s (TCI's) serving territory for Call routing - Location routing number absent and Basic listing interchange file service, respectively. The Commission also notes that Microcell operates in TCI's serving territory.

As noted above, in decision 97-8, the Commission required all CLECs to file proposed tariffs for interconnection, justifying any departure from the terms and conditions contained in the ILECs' tariffs. Accordingly, the Commission directs Microcell to:

- file proposed tariff pages within 30 days of the date of this order reflecting the lower interconnection rates issued by the ILECs pursuant to Decision 2002-34 with an effective date of 1 June 2003, or to provide cost justification for any departure from the ILECs' approved interconnection rates; and
|
|
|
- issue tariff pages forthwith reflecting the revised rates approved in Orders 2003-50 and 2003-136 for Call routing - Location routing number absent with an effective date of 27 January 2003, and for Basic listing interchange file service with an effective date of 31 March 2003.
