Northwestel Inc.

Terms of Service

1.

The Commission received an application by Northwestel Inc. (Northwestel), dated 2 July 2003, to amend General Tariff item 11, Confidentiality of Customer Records, in order to:
 

· add a list of the acceptable methods for obtaining express consent for the
 disclosure of confidential customer information, as directed in
 Confidentiality provisions of Canadian carriers, Telecom Decision
 CRTC 2003-33, 30 May 2003, as amended by Telecom Decision
 CRTC 2003-33-1, 11 July 2003;

 

· add provisions stating that express consent is not required where
  information is disclosed to:

 

(i) an agent retained by Northwestel to evaluate the customer's
    creditworthiness or

 

(ii) a public authority or agent of a public authority, if in the reasonable judgement of
     Northwestel, it appears that there is imminent danger to life or property which
     could be avoided or minimized by disclosure of information.

Northwestel also proposed to add a paragraph relating to the disclosure of the identity of the service provider to a law enforcement agency, as directed in Provision of subscribers' telecommunications service provider identification information to law enforcement agencies, Order CRTC 2001-279, 30 March 2001.

The Commission received no comments with respect to the application.

4.

The Commission approves Northwestel's application. The revisions take effect as of the date of this order.
