CJTK-FM Sudbury and its transmitter CJTK-FM-1 North Bay - Licence renewal

The Commission received an application by Eternacom Inc. to renew the broadcasting licence for the radio programming undertaking CJTK-FM Sudbury and its transmitter CJTK-FM-1 North Bay.

The Commission did not receive any interventions in connection with this application.

The Commission examined CJTK-FM's logger tapes for the week of 14 -20 January 2001 and found the tapes to be incomplete. Section 8 of the Radio Regulations, 1986 (the Regulations) requires licensees to keep a clear and intelligible tape recording or other exact copy of all matter broadcast for a period of at least four weeks from the date of broadcast, and to provide such recordings to the Commission upon request. These tapes are essential since the Commission uses them as its primary means to confirm that a station is operating in compliance with the Regulations and its programming commitments. Tapes are also used to assess complaints from listeners, if need be.

Further, in a letter to the Commission dated 12 June 2001, CJTK-FM indicated that 13% of the category 3 musical selections that it broadcast during the week of 14-20 January 2001 were Canadian selections. CJTK-FM is required, by condition of licence, to ensure that at least 20% of the category 3 musical selections aired during each broadcast week are Canadian selections.

In Practices regarding radio non-compliance, Circular No. 444, 7 May 2001, the Commission clarified its approach relating to radio stations operating in non-compliance.Given that this is the first instance of non-compliance by the licensee, and consistent with Circular No. 444, the Commission renews the licence for CJTK-FM for a four-year term, from 1 December 2003 to 31 August 2007, instead of the maximum term of seven years. This period will allow the Commission to assess, at an earlier date, the licensee's compliance with the Regulations regarding the maintenance of logger tapes and its condition of licence with respect to the level of Canadian music that must be broadcast.

The licence will be subject to the conditions set out in New licence form for commercial radio stations, Public Notice CRTC 1999-137, 24 August 1999, with the exception of condition of licence number 8, as well as to the following conditions of licence:
 
  • The licensee shall operate the station within the Specialty format as defined in A review of certain matters concerning radio, Public Notice CRTC 1995-60, 21 April 1995, and Revised content categories and subcategories for radio, Public Notice CRTC 2000-14, 28 January 2000, as amended from time to time.
 
  • The licensee shall, in a broadcast week, devote 20% or more of its musical selections from content category 3 to Canadian selections and schedule them in a reasonable manner throughout each broadcast day.
 
  • The licensee shall broadcast a maximum of four minutes of commercial messages per broadcast hour.

In accordance with Implementation of an employment equity policy, Public Notice CRTC 1992-59, 1 September 1992, the Commission encourages the licensee to consider employment equity issues in its hiring practices and in all other aspects of its management of human resources.
