Licence renewal for CKBY-FM Ottawa

The Commission renews the broadcasting licence for CKBY-FM Ottawa from 1 March 2003 until 31 August 2009, subject to the conditions set out in this decision and in New licence form for commercial radio stations, Public Notice CRTC 1999-137, 24 August 1999.

The Commission did not receive any intervention in connection with this application.

In Fifteen-month licence renewal for CKBY-FM and issuance of a mandatory order, Decision CRTC 2001-680, 7 November 2001, the Commission last renewed the licence for CKBY-FM from 1 December 2001 until 28 February 2003, due to the licensee's failure to comply with its conditions of licence. The Commission also issued Mandatory Order 2001-3, requiring that, at all times during the term of licence, the licensee comply with the condition of licence limiting hit material to less than 50% of all musical selections broadcast on CKBY-FM.

During the current term of licence, the Commission assessed the licensee's programming, and determined that Rogers was in full compliance with all conditions of its licence. The Commission notes that Mandatory Order 2001-3 remains in effect until the expiry of the current licence term on 28 February 2003.

It remains a condition of licence that the licensee shall broadcast on CKBY-FM, in any broadcast week, less than 50% hit material, as defined in Revised policy on the use of hits by English-language FM radio stations, Public Notice CRTC 1997-42, 23 April 1997, as amended in Changes to the charts used by the Commission to determine what constitutes a hit, Circular No. 445, 14 August 2001, and as may be further amended from time to time.

Because this licensee is subject to the Employment Equity Act and files reports with Human Resources Development Canada, its employment equity practices are not examined by the Commission.
