CJLF-FM Barrie - New transmitter in Peterborough

The Commission approves the application by Trust Communications Ministries to amend the licence for the radio programming undertaking CJLF-FM Barrie, Ontario, in order to operate a transmitter in Peterborough.

The application

The Commission received an application by Trust Communications Ministries (Trust Communications) to amend the licence for CJLF-FM, a Christian music station serving Barrie, Ontario. The applicant proposed to add an FM transmitter in Peterborough to broadcast CJLF-FM's programming.

Interventions

The Commission received sixty-six interventions addressing the application. Sixty-five interveners supported the application, while one intervener opposed it.

Supporting interveners included musicians, individuals associated with churches and religious organizations, and potential listeners. They considered that CJLF-FM's programming would increase the diversity of radio service available in the Peterborough market and would provide an outlet for music by Canadian Christian artists.

Ms. Bonnie Gauthier of Thunder Bay, Ontario, opposed the application. Ms. Gauthier submitted that a group from Peterborough was preparing to apply for a licence for a Christian station in Peterborough. She considered that the Peterborough group would be better suited to operate a Christian station to serve the market.

The applicant's reply

In reply, the applicant indicated that it had established a relationship with the Peterborough group. It submitted that the Peterborough group had reconsidered its plan to establish a low-power station and had opted instead to work with Trust Communications. The applicant stated that working with the Peterborough group had allowed Trust Communications to establish a link to Peterborough churches and businesses.

The Commission's analysis and determination

The Commission notes that the applicant has established a working relationship with a group of Peterborough residents. It further notes the strong support for the applicant's proposal expressed in supporting interventions. The Commission considers that the presence of CJLF-FM's programming will enhance the diversity of radio service available in Peterborough.

In light of the above, the Commission approves the application by Trust Communications to amend the licence for the radio programming undertaking CJLF-FM Barrie, Ontario, in order to operate a transmitter at Peterborough. It expects the licensee to include material that addresses the needs and interests of Peterborough residents in CJLF-FM's programming.

The transmitter will operate on frequency 89.3 MHz (channel 207A) with an effective radiated power of 500 watts.

The Department of Industry (the Department) has advised the Commission that, while this application is conditionally technically acceptable, it will only issue a broadcasting certificate when it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.

The Commission reminds the licensee that, pursuant to section 22(1) of the Broadcasting Act, this authority will only be effective when the Department notifies the Commission that its technical requirements have been met, and that a broadcasting certificate will be issued.

The transmitter must be operational at the earliest possible date and in any event no later than 24 months from the date of this decision, unless a request for an extension of time is approved by the Commission before 3 February 2005. In order to ensure that such a request is processed in a timely manner, it should be submitted in writing at least 60 days before this date.
