Further to its Broadcasting Notice of Public Hearing CRTC 2002-9 dated 21 August 2002 relating to a Public Hearing which will be held on 28 October 2002 at 9:30 a.m., at the Four Points Hotel, 105 King Street East, Kitchener, Ontario, the Commission announces that it will also consider the following. Application by ANTHONY SCHLEIFER, on behalf of 14863781 Ontario Ltd., to amend the licence of radio station CFWC-FM.

 

The licensee proposes to increasethe effective radiated power from 50 to 250 watts.

 

The existing technical parameters are for a low-power unprotected FM service. Consequently, the applicant is applying for an increase in the effective radiated power in order to protect the station.

 

This application is technically mutually exclusive with items # 5, 6, 8 and 11 of the Broadcasting Notice of Public Hearing CRTC 2002-9.

 

The Commission invites the public to regularly examine the public examination file of the above noted application in order to become aware of any additional information that could be filed in the future in response to clarification questions from the Commission.

 

The Commission will only proceed with this application at the public hearing if advised by the Department of Industry, at least ten days prior to the hearing, that it is technically acceptable.

Applications by BELL GLOBEMEDIA INC., on behalf of a new corporation to be incorporated (New RDS) and of The Sports Network Inc. (TSN Inc.), to effect an intra-corporate reorganisation with respect to Le Réseau des sports (RDS) inc. (RDS inc.) and TSN Inc.

 

RDS inc. is currently owned and controlled by CTV Specialty Television Enterprises Inc. (formerly known as NetStar Enterprises Inc.), with a holding of 99.96% of the voting interests. CTV Specialty Television Enterprises Inc. is, in turn, a wholly-owned subsidiary of CTV Specialty Television Inc. (formerly known as NetStar Communications Inc.).

 

RDS inc. is the licensee of the national French-language specialty television service Réseau des sports (RDS), providing a national sports programming service.

 

It has also been authorized to operate a category 1 national specialty television service to be known as Info-Sports, and a category 2 national specialty television service to be known as Le Réseau grand air. Both services are not yet operational.

 

TSN Inc. is currently owned and controlled by CTV Specialty Television Inc.

 

TSN Inc. is the licensee of the national English-language specialty television service The Sports Network (TSN), providing a national sports programming service, of the category 1 national specialty television service known as Women's Sports Network (WTSN) and of the category 2 national specialty television service known as ESPN Classic Sports. It also holds 21.42% of the voting rights of the national category 2 specialty television service known as The NHL Network Inc.

 

TSN Inc. has also been authorized to operate, on its own or in partnership, other national English-language category 2 services which are not yet operational.

 

The reorganization will consist of the following transactions:

 

a) Transfer of the ownership of the undertakings held by RDS inc.

 

The applicant proposes to transfer the assets of the RDS undertaking to New RDS, which will be a wholly-owned subsidiary of the current licensee, RDS inc.

 

The applicant is further requesting a licence to continue the operation of the undertaking, under the same terms and conditions, upon surrender of the current licence issued to RDS inc.

 

The applicant is also seeking authority to transfer the ownership of Info-Sports and Le Réseau grand air, under the same terms and conditions, so that, upon the fulfillment of the conditions found in Public Notices CRTC 2000-171 and 2001-98, New RDS will become the licensee of these services.

 

As part of the reorganisation, RDS inc. will change its name (new name yet to be determined), and New RDS will be named Le Réseau des sports (RDS) inc.

 

b) Change the effective control of TSN Inc.

 

The applicant proposes to change the effective control of TSN Inc. through the transfer of all of the issued and outstanding voting shares of TSN Inc. (1,000 common shares) from CTV Specialty Television Inc. to RDS inc.

 

This transaction will also result in a change in the authorized ownership of any unlaunched category 2 specialty television service in which TSN Inc. is authorized to hold interests.

Application by the CANADIAN BROADCASTING CORPORATION to amend the licence of radio station CBF-FM-8 Trois-Rivières, Quebec.

 

The licensee proposes to add a FMmono transmitter atLa Tuque to broadcast the programming of CBF-FM-8 Trois-Rivières, in order to adequately serve the population of La Tuque.

 

The transmitter will operate on frequency 103.7 MHz (channel 279 B) with an effective radiated power of 11,300 watts.

 

The Commission will only proceed with this application at the public hearing if advised by the Department of Industry, at least ten days prior to the hearing, that it is technically acceptable.

Application by RADIO HAUTE MAURICIE INC. to amend the licence of radio station CFLM La Tuque.

 

The licensee proposes to remove the condition of licence requiring that the station operates as an affiliate station of the CBC French FM Radio Network (CBC).

 

Radio Haute Mauricie inc. has modified its programming during the last years. The percentage of programs broadcast on air from CBC represents not more than 10% of CFLM's total programming.

 

Radio Haute Mauricie inc. has increased, since a couple of years, the local and regional information ratio. This enables Radio Haute Mauricie inc. to best serve the La Tuque local community interests.
