In a two step corporate transaction of NEXTLEVEL TELEVISION INC., on behalf of a corporation to be incorporated (Nextlevel Television) two corporations will be formed with one company to be owned and controlled by Mr. Prashant Desai and the other company to be owned and controlled by Mr. Benny Doro. |

The first step of this corporate transaction is application (2002-0267-2) by NEXTLEVEL TELEVISION, on behalf of a corporation to be incorporated, for authority to transfer Mr. Benny Doro's 50% ownership interest in Nextlevel Television to Mr. Prashant Desai. |
|||
The second step of this corporate transaction is application (2002-0268-0) by Mr. BENNY DORO (Nextlevel Doro), on behalf of a corporation to be incorporated, for authority to acquire the asset of the Category 2 specialty television service to be known as Power Television from Nextlevel Television. |
|||
In Decisions CRTC 2000-637 and 2000-638, the Commission awarded two Category 2 specialty television services to Nextlevel Television. The two services are to be known as: Urban Nation to provide music videos dedicated to urban hip-hop; and Power Television to provide music videos dedicated to hard rock and heavy metal music. The authorized licensee was to be equally owned by two individuals, Mr. Prashant Desai and Mr. Benny Doro. |

Following the transactions Mr. Desai will own and control 100% of Nextlevel Television, licensee of the Category 2 specialty television service Urban Nation, Mr. Doro will own and control 100% of Nextlevel Doro (OBCI), licensee of the Category 2 specialty television service Power Television. |
|||
The Commission will only issue licences when the licensees have entered into an agreement with a licensed distributor, and when a launch date for the Category 2 specialty television services have been identified pursuant to Public Notice CRTC 2001-98. |

The new station would operate on frequency 98.9 MHz (channel 255B) with an effective radiated power of 75,000 watts. |

The applicant is requesting permission to simulcast the programming of CJFX on the AM band for a period of three months from the date of implementation. |
|||
The Commission notes that the licensee is currently authorized to operate an FM transmitter CJFX-FM Antigonish, on frequency 98.9 MHz (channel 255B) with an effective radiated power of 2,750 watts which rebroadcasts the programming of the AM station. Should this application be approved, the FM transmitter will become the originating station. |

The proposed changes will improve the coverage in Squamish and the surrounding communities. |

The Commission, in Decision CRTC 2001-314, dated 5 June 2001, approved an application by the licensee to operate an Aboriginal-language FM radio station in Vancouver. However, the Commission did not approve the proposed frequency (90.9 MHz, channel 215B). |
|||
The applicant was to file an application proposing the use of a different frequency. |
|||
The applicant now proposes to operate the station on the frequency 92.3 MHz (channel 222 C1) with an effective radiated power of 1,200 watts. |
|||
