Mr. Willie Grieve Re: Telecom Public Notice CRTC 2002-1 - Northwestel Inc. (Northwestel) - Initial annual review of supplemental funding - Request by TELUS Communications Inc. for further process The Commission has received your letter dated 11 October 2002 on the above-mentioned filed. In your letter, you are requesting a Commission ruling as to whether or not the appropriateness of Northwestel's carrier access tariff (CAT) rate and its components are within the scope of this proceeding, and, if they are, to provide for a further formal process for comment on these issues. In support of your request, you noted that paragraph 9 of Telecom Public Notice CRTC-2002-1 (Public Notice 2002-1), which you indicated set out the scope of the proceeding, did not specifically refer to the company's CAT rate being under review. I note that the scope of the proceeding initiated by Public Notice 2002-1 is, in fact, set out in paragraphs 9 to 16 of that public notice. In particular, paragraph 13 sets out Northwestel's position that, among other things, "the current terms and conditions of long distance competition, including the seven-cent CAT rate, should be maintained as competition evolves". This paragraph concludes by inviting parties to the proceeding to comment on this proposal "in light of the fact that the contribution collection mechanism for the other telephone companies is now revenue-based, as established in Decision CRTC 2000-745, Changes to the contribution regime, dated 30 November 2000". A plain reading of paragraph 13 clearly indicates that issues related to the continued appropriateness of Northwestel's CAT are within the scope of this proceeding and the public notice clearly set out the process for commenting on the matter.
