National Contribution Fund Administration Agreement- French translation |

In this decision, the Commission approves an amendment to the National Contribution Fund Administration Agreement. The Commission also approves the French-language version of the agreement. |

The Commission has received an application by the Canadian Portable Contribution Consortium Inc. (CPCC), dated 17 April 2002, proposing an amendment to the National Contribution Fund Administration Agreement (NCFAA) and requesting approval of the French-language version of the agreement attached to the application. The proposed amendment to section 10.13 of the NCFAA provides that the English-language and French-language versions of the NCFAA are of equal force and effect. |

In CRTC approves the National Contribution Fund Administration Agreement, Order CRTC 2001-737, 21 September 2001 (Order 2001-737), the Commission approved the English-language version of the NCFAA, effective 1 January 2001. |

Section 10.13 of the NCFAA, as approved in Order 2001-737, provided that a translation of the agreement in the French-language version was available and that, in the event of a conflict between the English-language version and the French-language version, the English-language version was to prevail. |

Pursuant to the NCFAA, the CPCC is responsible for managing the national contribution fund established in Changes to the contribution regime, Decision CRTC 2000-745, 30 November 2000, and the CPCC may, with the written agreement of its members, amend the NCFAA, provided that the Commission approves such amendment. |

The Commission considers that proposed amendment is appropriate. The Commission also finds that the French-language version of the NCFAA attached to the application accurately reflects the English-language version of the agreement. Accordingly, the Commission approves the amendment to section 10.13 of the NCFAA and the attached French-language version of the NCFAA. |
