PREAMBLE |
||
At the 17 April public hearing the Commission will examine applications to renew the licences of 30 local television stations and a satellite network owned by CTV Television Inc. (CTV) and 19 owned by Global Television Network Ltd. (Global). These stations serve local markets in all the regions of the country. In Public Notice CRTC 1999-97: Building on Success - A Policy Framework for Canadian Television (TV Policy), the Commission announced that it would begin renewing all of the conventional licences held or controlled by a multi-station ownership group at the same time. Multi-station ownership groups exist where more than one conventional television station is owned or controlled by the same person or entity. The first of such groups to be renewed are the "large" ownership groups - those licensed to operate in several provinces with a potential reach of more than 70% of the audience in their language of operation. CTV and Global are the two such English-language groups. The renewal of the conventional licences held by Global and CTV is the first opportunity for the Commission to evaluate the plans of the major English-language groups against the provisions of the TV Policy. |

The Commission concluded that its new approach would allow for a proceeding that considered a multi-station group's corporate strategy, the methods of implementation of that strategy by individual stations, and the contributions of all aspects of a licensee's operations to the broadcasting system. The Commission also noted that while it would not necessarily entertain the renewal of specialty service licences at the same time as a multi-station group's conventional licences, it will take into account such group holdings in evaluating and renewing a group's conventional licences. |

The TV Policy provided each multi-station group with the flexibility to differentiate itself and brand its programming and scheduling to attract maximum audiences. However, it did so within a well-defined regulatory framework. Guided by that framework, the Commission intends to consider, among other things, the following issues at the hearing: |

The TV Policy stated that the Commission will take into account all of a group's holdings in evaluating and renewing a group's conventional licences. The Commission intends to pursue questions such as: |

The Commission's TV Policy broadened the definition of what it now terms "priority programming". The policy also introduced more flexibility for broadcasters to address the needs and expectations of Canadian audiences and to provide high-quality and diverse Canadian programming in peak time. The Commission intends to pursue questions such as: |

In its TV Policy, the Commission stated that it believes that audiences have a strong desire for a better reflection of Canada's regions to the country as a whole. The Commission intends to pursue questions such as: |

While the Commission no longer requires applicants to make quantitative commitments to local news programs, its TV policy does require all licensees to demonstrate how they will meet the demands and reflect the particular concerns of their local audiences, whether through local news or other local programming. The Commission intends to pursue questions such as: |

In its TV Policy, the Commission stated that it expects conventional television licensees, at licence renewal, to make specific commitments to initiatives designed to ensure that they contribute to a system that more accurately reflects the presence of cultural and racial minorities and Aboriginal peoples in the communities they serve. Licensees are expected to ensure that the on-screen portrayal of all minority groups is accurate, fair and non-stereotypical. The Commission intends to pursue questions such as: |

In its TV Policy, the Commission stated that, at licence renewal, it would explore with licensees the progress that has been made in meeting the needs of the visually impaired. The Commission intends to pursue questions such as: |

||
Both Global and CTV have ownership interests in various production companies. CTV's interest in Landscape Entertainment Corp. and Global's interest in Fireworks Entertainment International are the more notable of these. With that in mind, the Commission intends to consider the following: |
||

h) Cross-Media Ownership |
||
Both Global and CTV have recently acquired major newspaper holdings. CTV, Canada's largest English-language private conventional broadcaster, having recently had its acquisition by Bell Canada Enterprises (BCE) approved by the Commission, has now become part of a parent company that owns The Globe and Mail. Global, having recently become a broadcaster with national reach, acquired a number of newspaper assets from Hollinger Inc., including a 50% interest in The National Post. Both situations raise similar issues regarding the diversity of voices and editorial plurality on a national market level. Global's acquisition of a series of local newspapers raises similar cross-media issues on a more local level, particularly in the Vancouver/Victoria market. Given the current composition of these media companies, the Commission intends to consider the following: |

CTV has not filed an application to renew its network licence. The Commission intends to explore this in further detail. |
||
|
||
In its Decision CRTC 2000-747, approving the transfer of effective control of CTV Inc. to BCE Inc., the Commission set out an annual base expenditure level ($24.9 million) and reporting requirements to ensure the incremental nature of BCE's priority programming benefits expenditures ($140 million over 7 years). The Commission further provided that it may wish to discuss, at CTV's upcoming renewal hearing, the possibility of imposing reporting requirements with respect to priority programming as a condition of licence. |

Exception to the 12 Minutes per Hour Advertising Limit |
||
Section 11 (1) of the Television Broadcasting Regulations, 1987 provides that a licensee shall not broadcast more than 12 minutes of advertising material in any clock hour in a broadcast day, except as otherwise provided in subsections (2) to (4), or by a condition of its licence. |
