Scope of public hearing

As indicated in the letter dated 21 August 2001, persons wishing to participate during the oral portion of the above-noted proceeding have until 19 October 2001 to register with the Commission. Further, by letter dated 25 September 2001, parties to this proceeding were asked to comment as to what issues should be pursued during the cross-examination phase of the public hearing, scheduled to commence on 13 November 2001.

To date, Action Réseau Consommateur et al. (ARC) and James Bay Cree Communications Society (JBCCS) are the only parties that have responded to these letters and TELUS Québec and Télébec have replied to ARC's and JBCCS's letters. ARC and JBCCS have indicated that they intend to pursue various issues during the cross-examination phase of the public hearing. In these circumstances, it does not appear to be necessary at this time to limit the scope of the cross-examination phase of the hearing.

Matters preliminary to the organization of public hearing

Parties who intend to call witnesses are requested to provide a list of the witnesses they intend to call, indicating: (i) the subject matter of each witness' testimony; (ii) the evidence and interrogatory responses for which each witness is responsible; (iii) the order in which it is proposed that the witnesses will be presented; and (iv) whether they would appear individually or in a panel.

In order to assist the Commission with the organization and preparation for the oral hearing in this proceeding, interested parties are requested to file by 19 October 2001 with the Commission the information requested above, with a copy served on all other interested parties. Such information should be received, not merely sent, by that date. It is expected that a letter on the organization and conduct of the oral hearing will be issued by 1 November 2001.

Other Matters

By letters dated 5 October 2001, a third round of interrogatories was sent to both TELUS Québec and Télébec. Responses are due by 22 October 2001. Requests by parties for further responses to the interrogatories, specifying in each case why a further response is both relevant and necessary, and requests for public disclosure of information for which confidentiality has been claimed, setting out in each case the reasons for disclosure, must be filed with the Commission and served on all the parties by 26 October 2001. Written responses to requests for further responses to interrogatories and for public disclosure must be filed with the Commission and served on all parties by 31 October 2001. A determination will be issued with respect to requests for further information and public disclosure as soon as possible, and it is expected that any information to be provided pursuant to that determination will be filed with the Commission and served on all parties by 8 November 2001.

Finally, parties are reminded that, with respect to interrogatories that were sent to other parties to this proceeding (including ARC et al., AT&T Canada Corp./AT&T Canada Telecom Services, Bell Canada, MaxLink Communications Inc., Rogers Wireless Inc. and RSL COM Canada Inc.) on 5 October 2001, the dates for requests for further responses and for public disclosure of information and reply comments remain as set out in the 5 June 2001 letter.
