Deletion of the requirement that the licensee meet the minimum ratios of Canadian to non-Canadian programming on a per channel basis |

1. | The Commission approves the application by Viewer's Choice Canada Inc. to amend its condition of licence pertaining to minimum ratios of Canadian to non-Canadian programming on the service by eliminating the requirement that the licensee meet the ratios on a per channel basis. |
2. | Viewer's Choice is the licensee of an English-language pay-per-view television service available via satellite to cable affiliates in eastern Canada (Ontario, Quebec and the Atlantic provinces). It is currently subject to a condition of licence (number 2) which reads: |

3. | Amended condition of licence number 2 reads as follows: |

4. | Viewers Choice considers that the proposed amendment better reflects the realities of pay-per-view scheduling in a digital environment focused on offering an overall service. It will continue to maintain the existing exhibition ratios of Canadian to non-Canadian feature films and events over the entire service, no matter how many digital channels are dedicated to the service. |
5. | During the transition to full digital deployment, Viewers Choice will continue to meet the minimum ratios of Canadian to non-Canadian programming on a per channel basis for the portion of the service distributed in the analog mode. |
6. | The Commission acknowledges the intervention submitted by the Canadian Association of Film Distributors and Exporters and is satisfied with the licensee's response. |
